Quando duas pessoas decidem se casar, a ideia é que elas compartilhem não apenas o amor, mas também as responsabilidades e os recursos financeiros. No entanto, nem sempre essa divisão é justa ou equilibrada, e pode ocorrer que, no fim do relacionamento, quando do divórcio, um dos cônjuges seja prejudicado ao ser deixado em uma situação patrimonial desfavorável.

O que são Alimentos Compensatórios?

Além dos alimentos de subsistência, que contam com previsão legal, foi introduzido no ordenamento jurídico nacional, através de construção doutrinaria e jurisprudencial, a figura dos ALIMENTOS COMPENSATÓRIOS, também chamados, por alguns, de alimentos indenizatórios, os quais são uma forma de reparação financeira que pode ser concedida a um dos ex-cônjuges quando há um desequilíbrio econômico-financeiro resultante do casamento.

Este desequilíbrio financeiro entre o casal com o fim da união ocorre, geralmente, quando, após o divórcio, um dos cônjuges acaba ficando com o usufruto e a administração de todo o patrimônio comum, enquanto o outro fica sem acesso a praticamente nenhum (quando não lhe obstado todo o acesso) aos bens adquiridos na constância o relacionamento, o que se mostra, evidentemente, uma situação desfavorável, desarrazoada e desproporcional e merece ser reparada!

Confira o exemplo:

Maria e João adquiriram, na constância do casamento, três casas, sendo uma delas usada como moradia e as demais utilizadas como fonte secundária de renda pelo casal com aluguéis. Todo patrimônio está no nome do João e é por ele administrado. Ao dar entrada no divórcio, Maria sai de casa e perde total acesso à sua antiga residência e à fonte de renda que também teria direito. Neste caso, é inquestionável que Maria poderá pedir alimentos compensatórios para ser indenizada acerca da parcela proporcional do patrimônio que foi impedida de usufruir, já que não é razoável que João usufrua de todos os bens sozinho antes da partilha.

Fica claro que os alimentos compensatórios não têm por finalidade atender às necessidades de subsistência do credor, mas sim corrigir, atenuar ou indenizar grave desequilíbrio econômico-financeiro ou abrupta alteração do padrão de vida do cônjuge ou companheiro desprovido de bens e de meação. Em suma visam preservar o padrão de vida (condição social) do cônjuge prejudicado, ou seja, garantir a manutenção do status quo do alimentado após a separação ao mesmo tempo em que objetiva evitar qualquer enriquecimento sem causa do ex-cônjuge alimentante.

Até quando se deve pagar ou exigir estes Alimentos?

Desta forma, cabe destaque que a pensa aqui não guarda uma função permanente e vitalícia de manutenção. Sua natureza é a de reparar o desequilíbrio entre as partes até que se dissolvam as desvantagens sociais instaladas em razão do divórcio, na prática, geralmente é fixada com termo certo (data de início e fim, sendo que este geralmente coincide com a data da efetiva partilha dos bens amealhados pelo casal).

Alimentos Compensatórios vs. Pensão Alimentícia:

Vale destacar que, enquanto a pensão alimentícia tem finalidade eminentemente alimentar, com o fito de suprir as necessidades de subsistência do credor – o que já foi objeto de análise em outro artigo neste blog -, os alimentos compensatórios têm por escopo corrigir ou atenuar grave desequilíbrio econômico-financeiro ou abrupta alteração do padrão de vida do ex-cônjuge desprovido de bens e de meação, aqui com caráter, por sua vez, indenizatório.

Neste compasso, é entendimento predominante dos Tribunais que, ao contrário da pensão alimentícia, o inadimplemento aqui não pode ser sancionado com a medida drástica da prisão do devedor, neste caso deve ser tratado como uma dívida civil comum e os valores serem levados à execução como crédito ordinário.

Seguindo o mesmo raciocínio, não tendo os alimentos compensatórios o objetivo de assegurar a subsistência do credor, em relação a tal verba também não incide a previsão legal contida no artigo 1.708 do Código Civil, ou seja, o dever de prestar tal verba compensatória não cessa com o casamento, a união estável ou o concubinato do credor, já que independe da comprovação de qualquer dependência econômica.

Por fim, cumpre esclarecer que os alimentos compensatórios podem ser facilmente cumulados com a pensão alimentícia por dependência econômica. Ou seja, a depender obviamente do caso em concreto, existe a possibilidade de se solicitar e receber ambos os alimentos (pensão alimentícia e alimentos compensatórios), apenas um deles ou, até mesmo, nenhum destes.

Como são Fixados?

Pertinente se pontuar que estes alimentos podem ser fixados tanto em cláusula específica de acordo no caso de ambos os cônjuges estarem de comum acerca de sua fixação e valores ou, quando assim não for o caso, deverão ser analisados e fixados judicialmente por meio de pedido específico a ser elencado dentro da própria ação de divórcio ou dissolução da união estável ou, até mesmo, em ação própria para tanto.
