O divórcio é um processo difícil e doloroso para todas as partes envolvidas. Quando um casal decide dar entrada no processo de divórcio, pode haver muitas questões e decisões que precisam ser tomadas. Uma dessas questões pode ser a questão de onde cada cônjuge vai morar durante o processo de divórcio.

Antes de tudo, vale aqui destacar que a separação de fato se caracterizará a partir do momento em que o casal decide não mais conviver como marido e mulher e isso, evidentemente, independe de estarem residindo juntos na mesma moradia ou não.

Obs. A configuração da separação de fato é necessária para se fixar o marco final do relacionamento, ocasião em que se cessarão os deveres conjugais e o compartilhamento patrimonial, por exemplo.

A comprovação dessa separação pode ocorrer de várias maneiras, seja por uma declaração formal assinada pelo casal, seja na própria via judicial quando do protocolo do pedido de divórcio ou, até mesmo com testemunhos de pessoas próximas ao casal e/ou indicativos diversos de estarem vivendo como separados/solteiros.

Desta forma, superada tal questão, pode-se afirmar ser plenamente possível, durante o processo de divórcio, as partes continuarem a conviver sob o mesmo teto, ressalvada, obviamente, quando houver provas concretas apresentadas no processo sobre o risco de violência e agressão ou ao menos indícios do risco destas em desfavor de um dos cônjuges, ocasião em que uma das partes pode, de forma preliminar, ser forçada a deixar a residência comum.

Portanto, em regra, ambos têm direito de residir na casa comum e deverão conviver pacificamente até que o processo se encerre e as questões relativas à partilha dos bens sejam efetivamente sanadas e formalizadas. 

Cumpre observar que, ao término do processo de divórcio, caso não haja consenso entre as partes acerca de como irão proceder acerca da residência (se um irá comprar a parte do outro ou se irão aliená-la a um terceiro, por exemplo), o juiz não irá debater acerca de eventuais preferências ou necessidade de venda do imóvel, já que, na ocasião, seu papel é tão somente decretar a partilha dos bens, ou seja, irá determinar qual a quota parte que cada um dos envolvidos faz jus.

Obs. caso o casal chegue a um denominador comum, o ideal é que esta questão seja homologada dentro do processo para que, no caso de descumprimento, possa ser objeto de questionamento judicialmente e, a depender do caso, imposições de sanções.

No caso de não haver acordo homologado, em havendo interesse, as partes deverão discutir tal questão em uma ação judicial específica (ação de reintegração de posse, ação de extinção de condomínio, entre outras possibilidades a depender da situação em concreto) para eventualmente exercer seu direito de preferência na compra da parte do ex-cônjuge ou, até mesmo, forçar a venda da residência via leilão judicial para viabilizar a partilha e consequente divisão efetiva dos valores.
