O divórcio é um momento delicado na vida de qualquer casal, envolvendo não apenas aspectos emocionais, mas também questões jurídicas e financeiras. Com isso, é notório que a partilha de bens é um dos principais pontos a serem resolvidos durante o processo de divórcio, especialmente diante a capacidade de gerar desequilíbrio econômico entre o casal.

Neste ponto, os frutos dos bens possuem grande relevância, uma vez que, presumivelmente, aquele que entra na sociedade familiar com mais bens tenderá a tê-los aumentado pelos frutos gerados e é justamente aqui que costumam surgir dúvidas a respeito da possibilidade de divisão sobre os frutos recebidos durante o relacionamento (seja pelo casal, seja por apenas um dos cônjuges). Vejamos como a lei nos soluciona esta questão:

O que são Frutos?

Antes de tudo, tomemos como nota que os frutos, de maneiras gerais, são basicamente os rendimentos, lucros e benefícios que uma propriedade pode gerar.

O rendimento de aluguéis de bens (como aluguéis de imóveis residenciais ou locações por temporada em casa de praia, arrendamentos de áreas rurais, etc.); juros bancários de aplicações financeiras (como os rendimentos de poupanças, CDBs, fundos de investimentos, etc.); dividendos de empresas (no caso de haver ações na bolsa de valores de empresas que os distribuam); direitos autorais sobre obras intelectuais (no caso de um dos cônjuges ser autor de livros, filmes, músicas ou softwares que gerem rendimentos); são apenas alguns exemplos que podem ser citados aqui.

A quem pertencem os Frutos? Eles entram na Partilha?

Via de regra, os frutos estão totalmente correlacionados à propriedade do bem, ou seja, pertencem ao seu proprietário.

Acontece que ao falarmos de casamento, esta máxima pode ser alterada!

Por razões óbvias, o tratamento e destinação dos bens na partilha decorrente do divórcio é influenciada pelo regime de bens adotado pelo casal – o que já tratamos com detalhes em artigo específico – e, para isso, levaremos aqui em consideração as implicâncias no que atinge o Regime da Comunhão Parcial de Bens, já que é o mais comum atualmente.

Pois bem, dito isto, por força de lei, pode-se afirmar que os frutos oriundos de bens móveis, imóveis ou direitos, recebidos na constância do casamento integram o Patrimônio Comum do casal e como tal estão sujeitos à partilha no momento da dissolução de referida sociedade conjugal, ainda que provenientes de bens ou direitos incomunicáveis (bens particulares adquiridos antes do relacionamento ou recebidos a título de herança ou doação, por exemplo).

Entram na partilha os frutos tanto dos Bens Comuns quanto dos Bens Particulares de cada cônjuge, percebidos na constância do casamento, ou pendentes ao tempo de cessar a comunhão

Por fim, ainda é importante destacar que os frutos gerados após a separação de fato do casal, ou seja, após o término da convivência, não são considerados bens comuns do casal e, portanto, não entram na partilha de bens. Esses frutos são considerados, por óbvio, como pertencentes exclusivamente ao cônjuge que os obteve.

Como fica esta Questão Antes da Partilha?

É comum que os cônjuges tenham dúvidas em relação à administração dos bens e dos frutos durante o processo de divórcio. Nesse sentido, registra-se que, caso não haja comum acordo entre os envolvidos, é possível que o cônjuge que se sinta prejudicado faça pedidos dentro do processo para assegurar a administração dos bens ou até mesmo solicitar a meação imediata dos frutos recebidos durante o processo até o momento da partilha.

Vale aqui destacar que, caso um dos cônjuges acabe ficando com o usufruto e a administração de todo o patrimônio comum, enquanto o outro fica obstado do acesso ao patrimônio construído, ainda há a possibilidade de solicitação dos chamados alimentos compensatórios – que já detalhamos em outro artigo por aqui recentemente.

Conclusão

Desta forma, é de extrema relevância que aqueles que estão em processo de divórcio ou dissolução da União Estável fiquem atentos em relação a possibilidade de partilha de frutos pendentes à data da separação de fato, tanto quanto aos originados de bens comuns quanto aqueles advindos de bens particulares de um dos cônjuges.
