A pensão alimentícia é um tema bastante conhecido quando se trata de filhos menores de idade. Mas você sabia que ela também pode ser devida entre ex-cônjuges? Isso mesmo, em alguns casos, é possível que um ex-cônjuge tenha que pagar pensão alimentícia ao outro após a separação ou divórcio.

Mas Como Funciona essa Obrigação? E será que ela é Necessária em Todos os Casos?

Primeiramente, é importante destacar que a pensão alimentícia entre cônjuges não é uma obrigação automática. Ou seja, não é todo casal que precisa pagar ou receber essa pensão após a separação.

Ou seja, o valor da pensão pode ser fixado com base no que o ex-cônjuge necessita para manter o seu padrão de vida ou mesmo para garantir o seu sustento básico, considerando as despesas com alimentação, moradia, saúde, educação, entre outros.

Até Quando é Devido o Pagamento dessa Pensão?

No passado, era mais comum que o ex-marido pagasse alimentos à ex-mulher de forma vitalícia, já que, muitas vezes, ela se dedicava com exclusividade ao lar e filhos abandonando, por anos, qualquer potencial ingresso no mercado de trabalho, enquanto somente aquele contribuía financeiramente para o sustento do lar. Ocorre que hoje em dia, com a mulher cada vez mais inserida no mercado de trabalho, essa realidade já não é tão frequente assim.

Levando isso em consideração, o entendimento que vem predominando nos nossos Tribunais é o de que os alimentos devidos entre ex-cônjuges não podem servir de fomento ao ócio ou ao enriquecimento sem causa ao outro, motivo pelo qual devem ser fixados, em regra, com prazo determinado, ou seja, com data de início e fim!

Basicamente pode-se dizer que a pensão será fixada por tempo certo, com o fim específico de assegurar ao alimentado tempo hábil para sua inserção, recolocação ou progressão no mercado de trabalho, a fim de que isso lhe possibilite manter pelas próprias forças e atingir status social similar ao período do relacionamento.

Fica aqui a ressalva de que, em situações específicas e devidamente comprovadas, no caso de circunstâncias de incapacidade laboral permanente, ou, ainda, quando se constatar a impossibilidade prática de inserção no mercado de trabalho, devido à idade avançada, por exemplo, ainda se pode cogitar, de forma EXCEPCIONAL, a pensão de forma vitalícia.

Vale frisar que, se o alimentado (ex-cônjuge que recebe a pensão) vier a se casar novamente ou constituir uma união estável, perderá – por razões óbvias – o direito aos alimentos do ex-marido ou ex-mulher.

Já se o devedor dos alimentos se casar novamente, não haverá qualquer alteração na obrigação. Mas, obviamente, aqui também é pertinente se registrar quanto a possibilidade de que o valor seja modificado ou até mesmo a obrigação extinta, caso a situação fática se modifique e se prove que não há mais necessidade de pagamento, o que deverá ser apurado em ação judicial específica para tanto.

Como fica se o devedor Não Pagar?

De uma maneira bem clara e direta, em virtude do caráter alimentar desta pensão alimentícia, já que aqui a obrigação é fixada a título de auxiliar a subsistência do cônjuge menos favorecido e dependente financeiramente, registra-se que o não pagamento, a tempo e modo, dos referidos alimentos, pode acarretar cobranças na via judicial que podem, até mesmo, utilizar da medida sancionatória extrema de prisão do devedor, pelo prazo de um a três meses.

Conclui-se, assim, que a pensão alimentícia entre cônjuges é uma possibilidade real e legalmente prevista no Brasil. Sua necessidade e valor devem ser avaliados caso a caso, de forma justa e equilibrada, com o objetivo de assegurar a subsistência de quem dela necessita.
