Antes de tudo, ao falarmos das relações financeiras entre os cônjuges, é importante registrar que a legislação é clara ao dispensar, a luz da autonomia e liberdade financeira das partes, que cada um dos cônjuges possa, de forma autônoma e independente (veja, dispensada aqui autorização do outro), adquirir os bens necessários para a economia doméstica, inclusive por meio de dívidas e empréstimos.

Mas isso não significa que os cônjuges possam agir de forma irresponsável ou prejudicial ao patrimônio comum, uma vez que, em regra, quando do divórcio, assim como os bens adquiridos durante a relação, as dívidas assumidas também devem ser compartilhadas entre eles.

O casamento acabou, mas as dívidas contraídas ficaram. O que fazer?

Com o aumento da taxa de divórcios em todo o mundo, torna-se cada vez mais comum a pergunta sobre como ficam as dívidas do casal no divórcio.

Indo direto ao ponto, pode-se afirmar que a divisão das dívidas durante o casamento é feita de acordo com o Regime de Bens escolhido pelo casal antes do casamento, através do acordo pré-nupcial – e aí é que está uma das principais importâncias para a elaboração deste documento prévio ao casamento ainda culturalmente muito negligenciado pelos noivos, mas deixemos este assunto para um outro artigo.

Vale aqui destacar que, no caso de não terem feito o acordo pré-nupcial, estará valendo o regime legal de bens, que, para os casamentos firmados a partir de 1977, a legislação impõe a adoção do regime da Comunhão Parcial de Bens, o qual, por ser a grande maioria dos casos, tomaremos como base nas explicações deste artigo, ok?

Pois bem, partindo desta premissa, tudo o que foi adquirido onerosamente depois do casamento deve ser dividido (inclusive as dívidas). Então pode-se afirmar que, via de regra, as dívidas acumuladas durante o casamento, como já dito, são consideradas responsabilidades de ambos, independentemente de quem as tenha contraído.

É importante sempre se atentar à data em que a dívida foi contraída. Já que as dívidas contraídas ANTES do casamento são de responsabilidade individual de cada cônjuge, enquanto as dívidas contraídas DURANTE o casamento são consideradas responsabilidades conjuntas.

Ou seja, todos os débitos adquiridos durante o casamento são considerados responsabilidade conjunta do casal, incluindo empréstimos, financiamentos, cartões de crédito e outros tipos de dívida.

No entanto, devemos destacar aqui que, em alguns casos, o motivo pelo qual a dívida foi contraída também pode ser levado em consideração na repartição das obrigações de pagá-la, já que, por exemplo, se um cônjuge contraiu uma dívida para fins de lazer ou extravagância pessoal e particular, enquanto o outro contraiu uma dívida para pagar despesas domésticas essenciais, tudo isso deve ser levado em conta na hora da partilha.

Vamos entender melhor isso com um caso prático?

Tomamos como exemplo um caso em que João e Maria, casados sob o regime da comunhão parcial, entraram com uma ação de divórcio e ao se apurar os saldos do casal percebemos que existia uma dívida de cartão de crédito de dez mil reais em nome de João.

Em princípio esta dívida seria partilhada, porém Maria apresentou os extratos e ficou evidente que, do valor total da dívida, oito mil reais se referiam a um procedimento de implante capilar realizado pelo João.

Neste caso, Maria deverá arcar tão somente com os dois mil reais restantes, tendo em vista que oito mil reais foram usufruídos exclusivamente em benefício de João.

Vale destacar aqui, que a mesma situação valeria para Maria, caso as dívidas se referissem a ‘extravagâncias’  que a beneficiassem exclusivamente, como gastos com implante de silicone ou harmonização facial, por exemplo.

Conclusão

Desta forma, se o seu casamento acabou e ainda restaram dívidas conjuntas provenientes dessa fase, essa preocupação deve ser dividida entre você e seu ex-cônjuge.
