Nesse sentido, uma dúvida comum que surge é sobre o direito de partilha do FGTS no divórcio.

O FGTS (Fundo de Garantia do Tempo de Serviço) é um benefício previsto em lei que visa proteger o trabalhador em caso de demissão sem justa causa, além de ser utilizado para a compra de casa própria, entre outras finalidades. Outra questão relevante é o fato de que o cônjuge que não é titular da conta do FGTS não poderá movimentar a conta a seu bel prazer e, infelizmente, não terá acesso imediato ao dinheiro. Os valores depositados a título de FGTS só podem ser movimentados nas ocasiões previstas em lei (Lei 8.036/1990) e o divórcio não é motivo suficiente, por si só, para autorizar o saque dos valores.

Desta forma, na prática, costuma-se pedir judicialmente para que, uma vez determinada a partilha dos valores depositados, a Caixa Econômica Federal (banco responsável pela gestão das contas do FGTS) abra uma conta em nome do ex-cônjuge que não é o titular do FGTS para apartar a quota parte ao qual tem direito e, quando o titular for autorizado a sacar, também autorize o outro a usufruir da sua quantia livremente.

Por fim, é importante destacar que a partilha do FGTS é um direito que deve ser pleiteado por meio de uma ação judicial específica ou, no caso de resolução amigável da separação, constar expressamente nas cláusulas do acordo extrajudicial a ser homologado judicialmente ou registrado em cartório.
