Abandono Afetivo é um tema que gera muitas discussões no âmbito do Direito de Família. Esse termo é utilizado para descrever a situação em que um dos pais ou responsáveis não cumpre com suas obrigações emocionais em relação a um filho, gerando sequelas emocionais e psicológicas na criança ou adolescente.

São diversas as situações que exemplificam o abandono afetivo. Uma delas quando o responsável se ausenta da vida da criança por completo, não se importando com sua educação e bem-estar, mesmo tendo condições financeiras para isso, o que invariavelmente pode acabar gerando traumas e sequelas psicológicas permanente na vida dos filhos.

No Brasil, não existe uma legislação que trate especificamente sobre o abandono afetivo, mas a Constituição Federal prevê que é dever da família, da sociedade e do Estado garantir à criança e ao adolescente o direito à convivência familiar. O Estatuto da Criança e do Adolescente (ECA) estabelece que é direito fundamental da criança e do adolescente a convivência familiar e comunitária, bem como o direito à educação, cultura, lazer e profissionalização. Além disso, o Código Civil, por sua vez nos estabelece quais os deveres dos pais em relação aos seus filhos, dentre os quais podemos destacar a direção da criação e educação destes.

Pois bem, o abandono afetivo pode ter diversas características, como a falta de atenção, carinho e amor, que podem gerar consequências graves para a vida emocional e psicológica da criança. Algumas das consequências do abandono afetivo podem ser a dificuldade de estabelecer vínculos afetivos e relacionamentos interpessoais no futuro, depressão, a baixa autoestima, o sentimento de rejeição e abandono, além de problemas de saúde emocional e psicológica.

No âmbito jurídico, ainda é um tema bem polêmico que desafia algumas divergências e debates acalorados nos Tribunais do Brasil. Em todo caso, pode-se afirmar que o STJ tem entendido que o abandono afetivo pode gerar Danos Morais que merecem ser indenizados, principalmente quando a conduta do genitor causa sofrimento psicológico à criança ou ao adolescente.

Uma das decisões mais emblemáticas nesse sentido foi proferida em 2005, pelo Ministro Ruy Rosado de Aguiar, que concedeu a indenização por danos morais no valor de R$ 200 mil em favor de uma filha que ficou sem convivência com o pai por mais de 20 anos. No julgamento, o Ministro destacou que “a falta de convivência paterna pode gerar prejuízos de difícil ou impossível reparação, como distúrbios de personalidade, problemas emocionais, baixa autoestima, insegurança, falta de amor próprio e sentimento de rejeição“.

Outra decisão importante ocorreu em 2017, quando a Terceira Turma do STJ decidiu que um pai deveria indenizar a filha em R$ 50 mil pelo abandono afetivo. No caso em questão, o genitor não cumpriu seu papel de pai durante a infância e adolescência da filha, causando-lhe grande sofrimento e abalo psicológico.

Um terceiro exemplo é uma decisão proferida em 2019 pela Quarta Turma do STJ, que confirmou a indenização por danos morais no valor de R$ 50 mil em favor de uma filha que foi abandonada pelo pai na infância. No julgamento, os ministros destacaram que “a falta de afeto e a indiferença do pai, em um momento em que a filha mais precisava, causaram danos que ultrapassam o mero dissabor do cotidiano“.

Essas decisões mostram que o STJ tem reconhecido a gravidade do abandono afetivo e a necessidade de reparação dos danos morais causados e tal entendimento já está sendo replicado em diversos outros Tribunais do país. É importante ressaltar que cada caso é analisado de forma individualizada, levando em consideração as particularidades e as provas apresentadas nos autos.

Obs. é pertinente se pontuar que a mera existência de afeto e a sua ruptura, por si só, não caracterizam o abandono afetivo. Para que haja a responsabilidade civil e o dever de indenizar, é necessário comprovar a existência do dano e do nexo causal entre a conduta do abandono e o prejuízo sofrido, o que, evidentemente, pode ser comprovado por diversas meios de provas, como depoimentos testemunhais e laudos psicológicos e psiquiátricos por exemplo, o que, evidentemente, pode variar e deve ser analisado caso a caso conforme as peculiaridades da situação em concreto.

Portanto, é importante destacar que o abandono afetivo é um tema delicado e que merece ser tratado com responsabilidade. É fundamental que os pais ou responsáveis estejam presentes na vida dos filhos, não só na questão material, mas também na questão emocional. O diálogo e a afetividade são essenciais para a formação de um ser humano saudável e feliz.

Vale ressaltar que a jurisprudência tem se posicionado nestes casos que o prazo prescricional são de três anos e começa a contar a partir do momento em que a vítima completa a maioridade, ou seja, o prazo para exercer o direito de ação (leia-se: pedir a indenização) se encerra aos 21 anos de idade. Caso o pedido seja feito após esse período, o direito à indenização estará prescrito, ou seja, extinto, e não poderá mais ser formulado judicialmente.
