A pensão alimentícia é um tema que costuma gerar muitas dúvidas.

O que são Alimentos Avoengos?

Os avós podem ser chamados a pagar pensão alimentícia em casos excepcionais e específicos, como quando os pais não têm condições de prover a subsistência dos próprios filhos, seja por motivo financeiro, falecimento ou de saúde, por exemplo.

Nessa situação, a responsabilidade pode ser estendida aos avós paternos, maternos ou de ambos, é o que chamamos de alimentos avoengos ou pensão avoenga, e ela é determinada com base no princípio da solidariedade familiar, da dignidade da pessoa humana e do melhor interesse da criança, afinal, neste caso, compete aos ascendentes mais próximos o devido amparo e auxílio ao menor em situação frágil.

No entanto, essa obrigação só pode ser exigida dos avós se ambos os pais – responsáveis imediatos – não tiverem condições financeiras para tanto e, claro, comprovada a devida necessidade do menor.

Desta forma, pode-se afirmar que a obrigação alimentar dos avós possui natureza complementar e subsidiária, somente configurada no caso da impossibilidade total ou parcial de seu cumprimento pelos pais da criança

não é possível demandar diretamente os avós antes de buscar o cumprimento da obrigação por parte dos pais, bem como não é possível transferir automaticamente de pai para avô a obrigação do pagamento (casos de morte ou desaparecimento)

É importante, ainda, ressaltar que, caso os avós sejam reconhecidos como responsáveis pelo pagamento de pensão alimentícia e não cumpram com suas obrigações, eles também poderão sofrer as consequências da prisão civil, uma sanção prevista em lei para garantir o cumprimento da obrigação alimentar. É fundamental, portanto, que todos os envolvidos tenham ciência das suas responsabilidades e cumpram com suas obrigações para evitar problemas futuros.

Quais os Valores dos Alimentos Avoengos?

Aqui como em toda espécie de alimentos, a legislação não nos traz um valor fixo e a análise é evidentemente casual, variando a depender das realidades e peculiaridades do caso em concreto.

Por óbvio aqui, a responsabilidade dos avós pela prestação alimentar deve estar dentro de seus meios econômicos possíveis, a fim de que estes também não sejam prejudicados, nem o seu próprio sustento.

Assim, no que diz respeito aos valores a serem pagos pelos avós, a fixação deve ser sempre baseada na renda dos avós e nas necessidades da criança, em respeito ao binômino necessidade-possibilidade, portanto, a obrigação é proporcional à necessidade da criança e à capacidade financeira dos avós.

Os alimentos avoengos não podem ser cumulativos com a pensão alimentícia paga pelos pais. Ou seja, se os pais já estão pagando pensão alimentícia para o filho, os avós não podem ser obrigados a pagar uma pensão alimentícia adicional.

Obrigação conjunta de Avós Paternos e Maternos

Conforme imposto pela própria lei a prestação de alimentos é uma obrigação a ser cumprida proporcionalmente entre todos os obrigados.

No caso de pensão avoenga, o entendimento que prevalece é o de que todos os avós podem ser convocados a dividir a obrigação alimentar aos netos

Por isso, se a ação que requer alimentos for ajuizada em face somente dos avós paternos, por exemplo, é possível que estes convoquem os avós maternos – ou vice-versa – com o intuito de dividir a obrigação, já que ela é aqui concorrente e solidária e, por isso, pode ser diluída entre os avós dentro da possibilidade particular de cada um.

Se os pais retomarem a capacidade financeira de arcar com a pensão alimentícia, os avós serão desobrigados do pagamento.

Conclusão

Como visto, a obrigação alimentar dos avós possui caráter subsidiário e complementar, apenas sendo cabível diante da falta dos obrigados principais ou da comprovada impossibilidade destes arcarem com a obrigação.
