Inobstante não haver um valor certo pré-definido por lei, destaca-se que os alimentos serão fixados de acordo com o binômio necessidade-possibilidade, ou seja, deverá será apurado conforme as necessidades de quem pede e com as possibilidades financeiras de quem paga.

Nesta toada, para definir o valor justo da pensão alimentícia, é preciso considerar alguns fatores importantes, como a idade do alimentado, uma vez que as necessidades e gastos variam de acordo com a idade, bem como os custos de vida na região da residência, já que os preços podem variar bastante de acordo com a localidade vivida, por exemplo, tudo com o fim de se adequar às reais necessidades do menor.

A pensão vai ser sempre sobre 30% do salário do pai?

As formas de cálculo mais usuais são através do arbitramento em valor fixo ou em percentual sobre o salário do alimentante.

Obs. ao se vincular ao salário do alimentante prevalece o entendimento de que a base de cálculo será o salário líquido e não bruto, aqui abatidos apenas os descontos obrigatórios, como imposto de renda (IRPF) e contribuições previdenciárias.

É importante as partes estarem plenamente cientes acerca dos efeitos futuros da determinação da pensão, já que se fixado em um valor fixo ele só irá atualizar se na decisão que o fixou indicar um índice de correção específico (na prática ele costuma geralmente ser atrelado ao salário mínimo), noutra sorte no caso de ser fixado com base no salário do outro cônjuge, variará somente se o salário deste sofrer algum reajuste (tanto pra mais quanto pra menos).
