Com a decisão de casar, é comum que os noivos se preocupem com a escolha do regime de bens que irá reger o casamento, na medida em que este é o “guia” que definirá as implicações práticas patrimoniais do casal até que o relacionamento se encerre (seja pela morte de um dos cônjuges ou pelo divórcio do casal)

No entanto, após a celebração do casamento e no curso do relacionamento é muito comum que ocorram mudanças nas circunstâncias pessoais do casal, seja de índole financeira ou até mesmo moral, e isso eventualmente acabe justificando um “ajuste de rota” com a alteração do regime de bens outrora escolhido.

Neste artigo, vamos abordar as possibilidades de mudança de regime de bens após o casamento e as implicações desse processo.

O que é Regime de Bens e como ele é Definido?

Primeiro vamos esclarecer que o regime de bens é um conjunto de regras que define a forma como os bens do casal serão geridos durante o casamento e após ele, em caso de separação ou falecimento de um dos cônjuges.

Imagine-o como um “contrato” que você assina com seu parceiro ou parceira quando decide se casar. Esse contrato define como vocês irão lidar com suas propriedades, dívidas e aquisições enquanto casados.

No Brasil, existem cinco regimes de bens possíveis que podem ser adotados pelo casal no momento da celebração do casamento, seja por convenção (escolha dos noivos) ou imposição legal (regime obrigatório), quais sejam: comunhão universal de bens; comunhão parcial de bens; separação total de bens; separação obrigatória de bens e o regime da participação final dos aquestros.

O regime é escolhido antes do casamento via pacto antenupcial ou, quando inexistente, imposto expressamente pela lei o regime da comunhão parcial de bens.

É Possível Alterar este Regime Depois do Casamento?

Sim, é possível alterar o regime de bens após o matrimônio. No entanto, para fazer essa mudança, é necessário cumprir alguns requisitos e seguir um procedimento específico previsto e lei. Vamos entender melhor:

Primeiramente, é importante lembrar que a mudança do regime de bens só é possível em casos excepcionais e mediante autorização judicial, ou seja, será necessariamente formalizada via ação judicial específica para isto.

EXCEÇÃO: no caso da união estável formalizada, o CNJ recentemente (Provimento nº 141/2023) passou a admitir o processamento do requerimento de ambos os companheiros para a alteração de regime de bens no registro de união estável diretamente perante o registro civil das pessoas naturais!

Além disso, esta autorização somente será concedida se cumpridos os seguintes requisitos previstos em lei:

  • Justifica Plausível: para solicitar a mudança do regime de bens, é necessário comprovar que as circunstâncias do casal se alteraram de tal forma que justifique a mudança do regime de bens escolhido anteriormente;

 Por exemplo, se um dos cônjuges passou a desenvolver uma atividade empresarial e possuir bens em seu nome, pode ser necessário mudar o regime de bens para garantir a proteção dos interesses do casal.

  • Seja feito de forma Consensual (amigável): os cônjuges necessariamente devem tomar esta decisão de comum acordo e assinar a petição conjuntamente;
  • Não haja Prejuízos a Terceiros: ao requerer a alteração, os cônjuges deverão comprovar que a alteração de bens pretendida não afetará terceiros potencialmente envolvidos e correlacionados ao casal, como filhos ou credores:

Obs. geralmente a comprovação aqui se dá via apresentação de certidões negativas, como tributárias, trabalhista e de protesto, por exemplo.

Durante o processo, a proposta de alteração também passará por aval do Ministério Público e a intenção do casal será publicada em edital próprio a fim de dar plena publicidade a mudança proposta.

Superadas estas questões, não havendo oposição do Ministério Público nem de terceiros, o pedido será homologado judicialmente e, posteriormente, formalizados por averbação nos cartórios de registro civil e de imóveis competentes.

E a partir de Quando passa a Valer essa Alteração?

Por fim, é importante pontuar que, em regra, a mudança de regime só terá efeito a partir da data do trânsito em julgado da sentença que aprovar a alteração, ou seja, somente após a decisão que autorizou a mencionada alteração se tornar definitiva (quando acabado os prazos e não couber mais recursos).

Em termos mais claros, isso significa que a alteração não influenciará os bens adquiridos antes da mudança do regime de bens, salvo, claro, decisão judicial em sentido contrário.

Mas é oportuno aqui se fazer algumas observações/exceções:

Se o novo regime for mais restritivo (alteração de comunhão parcial para separação total, por exemplo), não é possível fazer a mudança de forma retroativa e os bens adquiridos antes da alteração continuarão sujeitos ao regime anterior.

Agora se o novo regime for mais benéfico (alteração inversa, da separação total para comunhão parcial, por exemplo), os cônjuges podem solicitar que os bens adquiridos antes da alteração sejam sujeitos ao novo regime e o pedido, obviamente, será objeto de análise na decisão judicial.

Obs. os Tribunais já tem entendido de forma pacífica que a alteração de qualquer regime para o regime da comunhão universal retroage automaticamente, ou seja, todos os bens passam a ser comuns desde a data do casamento.

Conclusão

A mudança do regime de bens pode trazer consequências jurídicas importantes, que devem ser avaliadas com cuidado antes de serem tomadas. Por isso, é fundamental contar com a orientação de um advogado especializado em direito de família antes de tomar qualquer decisão.
