O casamento é uma das decisões mais importantes da vida de uma pessoa. É um compromisso sério e duradouro que deve ser tomado com responsabilidade e maturidade.

Primeiramente, deve-se dizer que o casamento é um ato formal submetido a diversos requisitos previstos em lei. Esse é o motivo pelo qual existe um processo de habilitação de casamento, em que aqueles que pretendem se casar devem apresentar documentos que demonstrem a capacidade civil dos noivos e a eventual existência de impedimentos matrimoniais.

E a idade dos noivos e pretendentes ao casamento é, claro, um dos requisitos exigidos por lei, vamos entender melhor as peculiaridades e demais detalhes relacionados ao casamento na infância/adolescência.

Afinal, menores de idade podem se casar?

Embora pareça uma situação rara de se acontecer, ela é possível, desde que observados alguns critérios específicos.

Por mais que a maioridade civil, no Brasil, só seja atingida ao se completar 18 anos de idade, ao falarmos de idade núbil – termo técnico que indica a idade mínima para se casar – a legislação autoriza o casamento a partir dos 16 anos.

Veja bem, até 2019, era possível o chamado “casamento infantil”, de menores de 16 anos em situações excepcionais, como no caso de gravidez precoce ou em situações de risco iminente à vida da gestante, por exemplo. Em tais casos, era necessária a autorização dos pais ou responsáveis legais e uma autorização judicial.

Mas com a vinda da Lei nº. 13.811 de 12 de março de 2019, houve uma alteração legislativa que proibiu expressamente, em qualquer hipótese, o casamento de crianças/adolescentes que não atingirem a idade núbil. Esta é a regra vigente nos dias de hoje, que, se não observada, pode ser questionada e o casamento anulado judicialmente.

Necessidade de autorização dos pais ou responsáveis legais

Os menores de idade (aqui, como visto acima, estamos falando daqueles de 16 ou 17 anos), por ainda serem, aos olhos da lei, relativamente incapazes para tomarem suas próprias decisões, não podem se casar sem a autorização expressa de seus pais ou responsáveis legais.

Essa autorização deve ser dada por escrito, por meio de um documento chamado de “consentimento matrimonial”. Esse documento deve ser registrado em cartório, assinado por ambos os pais ou responsáveis legais e apresentado no momento da habilitação prévia ao casamento.

O casamento celebrado sem essa autorização é irregular e poderá ser considerado nulo pela Justiça!

Vale o destaque aqui que, caso os responsáveis não concedam a autorização ou discordem entre eles a respeito do assunto, o menor interessado poderá procurar um advogado para ingressar com uma ação própria de suprimento de consentimento e solicitar o aval da Justiça.

Nesses casos, para evitar um matrimônio impensado ou até mesmo decorrente de impulsos frenéticos e apaixonados, com visível intuito de proteção ao próprio interessado, o juiz costuma, antes de qualquer decisão, ouvir os pais do adolescente para entender os reais motivos da recusa  e somente autoriza o casamento se houver visível abuso do direito pelos responsáveis. Ao final, em sentença judicial, se analisará a questão e autorizará o matrimônio, substituindo a autorização dos pais.

Obs. Destaca-se que, no caso de casamento realizado desta forma, via autorização judicial, a legislação impõe necessariamente a adoção do Regime de Bens da Separação Legal.

Divórcio na adolescência

E se o casamento ocorrer na adolescência e os jovens desejarem se separar? Será que eles precisam de autorização para se divorciar? A resposta aqui é não.

Uma vez casados, os jovens passam a ter a mesma capacidade civil dos adultos, já que ocorre aqui o que chamamos de emancipação automática, e passam a poder tomar sozinhos decisões importantes como a do divórcio.

No entanto, o divórcio na adolescência pode ter consequências emocionais e psicológicas significativas para os jovens. É importante que eles recebam apoio e orientação de profissionais especializados, como psicólogos e assistentes sociais. Além disso, é importante que os jovens tenham acesso à informação e educação sexual para evitar gestações precoces e casamentos na adolescência que possam ser prejudiciais a sua saúde, bem-estar e ao próprio futuro dos menores.

O casamento na adolescência é uma decisão séria e deve ser tomada com responsabilidade e maturidade. É importante que os jovens entendam as implicações legais e emocionais do casamento na adolescência e recebam o apoio adequado para tomar decisões tão importante em suas vidas.
