I – Fidelidade recíproca

II – Vida em comum, no domicílio conjugal (coabitação)

No entanto, atualmente, esse dever é relativizado, uma vez que é plenamente possível que cada cônjuge tenha sua própria moradia separada sem que isso afete a validade do casamento.

O importante é que exista uma convivência harmoniosa e respeitosa entre os cônjuges, independentemente de morarem no mesmo local.

III – Mútua assistência

O terceiro dever é o da mútua assistência, que vai muito além da assistência financeira.

Esse dever se traduz no fornecimento de alimentos, vestuário, medicamentos e até mesmo outros aspectos práticos, envolvendo também fatores intrínsecos, como sinceridade, honra e privacidade um do outro, por exemplo.
A mútua assistência abrange o suporte emocional e o apoio nas necessidades diárias da vida conjugal.

IV – Sustento, guarda e educação dos filhos

O quarto dever diz respeito ao cuidado com os filhos, abrangendo o exercício do poder familiar.

Tanto o marido quanto a mulher têm a responsabilidade igualitária de guardar, educar e sustentar os filhos, mesmo em caso de separação ou divórcio.

É fundamental que os cônjuges compartilhem as obrigações parentais de forma equitativa, visando sempre o bem-estar e o desenvolvimento saudável dos filhos.

V – Respeito e consideração mútuos

Por fim, o quinto dever é o do respeito e consideração mútuos. Esse dever envolve a estabilidade moral e psicológica da união, exigindo cuidado com os sentimentos e os ideais do outro.

O respeito mútuo é essencial para o fortalecimento do vínculo conjugal, promovendo uma convivência saudável e harmoniosa.
