Como funciona a Partilha de Bens Móveis no Divórcio?

A primeira coisa que precisamos entender é que a partilha dos móveis da casa, assim como a partilha de todos os bens do casal, dependerá sempre do regime de casamento escolhido pelo casal.

Abordando de maneira geral o regime da comunhão parcial de bens, que é o mais comum no Brasil, tempos que no que se refere aos bens móveis do casal, há presunção legal de que todos foram adquiridos durante o casamento, a menos que se prove o contrário, isso é o que o artigo 1.662 do nosso Código Civil determina.

Então fique atento! Caso não tenha interesse em partilhar as mobílias e demais objetos móveis de casa adquiridos antes da formalização do seu relacionamento, terá que necessariamente, quando do divórcio, apresentar provas da data certa da sua compra/aquisição.

Formas de Partilha:

Quando se trata da divisão dos móveis, existem duas formas possíveis: a divisão física e a compensação financeira.

  • Divisão Física: Nesse caso, os móveis são literalmente divididos entre os cônjuges de maneira igualitária. Cada um ficará com a metade dos bens, considerando seu valor e utilidade.
  • Compensação Financeira: Quando a divisão física não é possível ou não quista, seja por motivos práticos ou pela existência de bens indivisíveis, pode-se estipular uma compensação financeira para equilibrar a partilha. Nesse caso, o valor dos móveis pode ser avaliado e um cônjuge compensará o outro com uma quantia correspondente.

É importante destacar que a partilha de móveis deve considerar o valor real dos bens, levando em conta o estado de conservação, a antiguidade e o preço de mercado. Caso os cônjuges não cheguem a um acordo, o juiz poderá solicitar uma avaliação pericial para determinar o valor dos móveis.
