Resolver um problema de forma consensual, por meio de um acordo, é uma alternativa vantajosa para diversas situações. Quando as partes envolvidas em um conflito conseguem chegar a um consenso, evitam-se desgastes emocionais, custos elevados e a demora do processo judicial.

No entanto, surge uma dúvida comum: é possível que o juiz se recuse a homologar o meu acordo? Neste artigo, iremos abordar essa questão e entender como funciona a homologação de acordos no direito brasileiro, considerando a diferença entre direitos disponíveis e indisponíveis.

Ao falarmos de divórcio, precisamos antes de tudo, fazer a análise das cláusulas do acordo sob dois prismas: de um lado o “direito dos adultos”, no que atine o pedido de separação propriamente dito, o retorno ao uso do nome de solteiro, a disposição da partilha dos bens amealhados pelo casal, a existência ou não dos alimentos entre os ex-cônjuges. Sobre tais temáticas, pode-se dizer que as partes têm plena liberdade para negociar e decidir o que é melhor para elas. A concretização do acordo depende apenas da manifestação de vontade das partes, e o juiz tem como função homologar o acordo, ou seja, torná-lo válido legalmente.

Inobstante a liberdade em convencionar o que lhes for mais conveniente, e o entendimento de ser incabível a recusa à homologação do pacto em relação às cláusulas referentes aos ex-cônjuges, há de se ressaltar que, em casos excepcionais, é possível que haja uma certa discricionariedade judicial por ocasião da homologação do acordado, principalmente no que atine situações de evidente desequilíbrio entre as partes ou, eventualmente, casos de constatada violência doméstica ou patrimonial, motivo pelo qual uma partilha muito desproporcional ou até mesmo, a depender do caso em concreto, a renúncia a alimentos entre ex-cônjuges podem ser fatores que sirvam de alerta ao magistrado para analisar a situação com mais cautela e quiçá recusar a homologação.

Isso porque, apesar da disposição de vontades das partes, o magistrado possui sempre o poder-dever de evitar vícios, atos simulados, fraudes ou qualquer situação que prejudique alguma das partes envolvidas. A finalidade é garantir que a transação submetida ao Judiciário seja justa e equilibrada.

Noutro compasso, quando estamos tratando de assuntos relacionados às responsabilidades parentais – em outras palavras, o “direito das crianças” (ao falarmos dos filhos menores de idade), como guarda, regulamentação da convivência e fixação da pensão alimentícia dos filhos menores, os direitos em questão são considerados indisponíveis. Isso significa que o acordo proposto pelas partes deve passar por um crivo mais criterioso e minucioso pelo Poder Judiciário, levando em consideração o interesse primordial da criança.

Nessas situações, o acordo assume o caráter de uma ‘proposta’ submetida ao juiz, que irá sopesar outros interesses, especialmente o melhor interesse da criança. O magistrado possui aqui total prerrogativa de homologar ou não os termos do acordo, garantindo que a decisão esteja em conformidade com os direitos e necessidades da(s) criança(s) envolvida(s).

É importante ressaltar que, em processos que envolvem menores de idade, o Ministério Público tem a obrigação de intervir, atuando como fiscal da lei e com a função de proteger os interesses da criança, certificando-se de que o acordo proposto esteja sempre em conformidade com a lei e com o melhor interesse do menor.

Assim, mesmo que as partes tenham manifestado sua vontade nas cláusulas do acordo, o juiz não é obrigado a homologá-lo quando, ao seu ver, o combinado não refletir a melhor solução ao caso concreto.

Cabe destacar que, como em qualquer decisão judicial, é possível interpor recursos caso as partes não concordem com a decisão do juiz. Portanto, a via recursal pode ser utilizada na tentativa de reverter o resultado, caso haja fundamentos para tal.
