O que são Medidas Liminares

Quais Liminares podemos pedir em um Divórcio

Mas, de uma maneira geral, podemos listar as seguintes possibilidades:

  • Em relação aos FILHOS: para regulamentar de forma temporária a situação dos menores durante o processo de divórcio:

– guarda provisória;

– regulação provisória das visitas;

– fixação de pensão alimentícia provisória;

– pedido de restrição à saída para o exterior com os filhos (no caso de possibilidade de ‘fuga’ de um dos cônjuges com o filho, por exemplo).

  • Em relação ao CÔNJUGE: para regulamentar de forma temporária a situação do casal, propriamente dito, durante o processo de divórcio:

– separação de corpos;

– pensão alimentícia provisória ao cônjuge;

– alimentos compensatórios;

– aluguel pelo uso exclusivo de bem comum do casal;

  • Em relação aos BENS: para assegurar a partilha justa dos bens do casal e, quando necessário, evitar alienação antecipada, depreciação, ocultação ou até mesmo dilapidação patrimonial:

– avaliação liminar dos bens a serem partilhados;

– bloqueio de bens;

– quebra de sigilo bancário;

Natureza Provisória

Cabe aqui lembrar que a decisão liminar é sempre provisória. Ou seja, ela não tem efeitos de decisão final dentro de um processo, o que significa que esse tipo de decisão não indica que o processo já está finalizado, nem que a parte que fez o pedido irá, de fato, ganhar o processo.

Ela é apenas uma forma de garantir à parte que um pedido de urgência seja atendido, pois o não atendimento antecipado do mesmo pode potencialmente causar danos irreparáveis aos envolvidos caso estes necessitassem aguardar até o final do processo judicial.

Assim, dada a esta natureza temporária, caso o juiz veja que a providência determinada de forma liminar não é mais necessária, ela pode ser revogada ou revista a qualquer momento durante o processo, ok?

E se meu Pedido for Indeferido?

Lembrando que, assim como todos os pedidos, as liminares precisam ser fundamentadas e devidamente provadas, ainda mais porque a ‘simples’ alegação de urgência não costuma ser suficiente para que o pedido seja automaticamente aceito por um juiz.

Da mesma forma, devemos entender que sempre há a possibilidade do pedido ser indeferido (negado). Cumpre pontuar, todavia, que, do mesmo modo que um pedido concedido não significa que o processo está ganho, aqui, um pedido negado não impõe necessariamente a perda definitiva do processo no futuro.

Após o exame dos pedidos liminares, o processo ainda terá um longo caminho para falas, argumentações, pedidos e produções de provas que influenciarão na decisão final da ação.

Uma vez negado o pedido liminar, compete ao advogado responsável avaliar se é pertinente levar a discussão adiante via recurso para o Tribunal competente ou não.
