Afinal, o filho adotivo também teria direito a pensão?

A pensão alimentícia é um tema que sempre gera muitos questionamentos e controvérsias no direito brasileiro. Uma dúvida bastante recorrente é a de como que ficam os direitos dos filhos no caso de em encerramento do casamento dos pais adotivos.

É importante esclarecer, antes de tudo, que, nossa própria Constituição Federal assegura o princípio da igualdade entre os filhos, onde se garante que todos os filhos, independentemente da forma como foram concebidos, tenham exatamente dos mesmos direitos.

Caso o pai ou a mãe adotivos se recusem a pagar a pensão alimentícia, é possível se ingressar com uma Ação Judicial de Alimentos, que tem como objetivo determinar a obrigação alimentar e fixar o exato valor que será pago mensalmente ao filho adotivo. Nessa ação, é preciso apresentar provas da necessidade do alimentando e da possibilidade do alimentante em arcar com o valor da pensão.

É importante que o valor da pensão seja adequado às necessidades da criança e às possibilidades financeiras do genitor obrigado a pagar. Além disso, é possível pedir a revisão do valor da pensão a qualquer momento, caso ocorra alguma mudança na situação financeira dos pais ou na necessidade da criança.
