Quando um casal está pensando em se separar ou terminar sua relação estável, é comum que surjam muitas dúvidas e perguntas sobre o que fazer. Às vezes, eles podem até se arrepender e querer voltar atrás na decisão. Isso acontece porque lidar com um momento tão importante e complicado pode ser confuso.

Antes de decidir se vão se separar de vez ou tentar de novo, é importante que o casal saiba bem o que está acontecendo. Eles precisam entender as opções que têm, o que podem ou não fazer nesse processo e quais serão as consequências das escolhas que fizerem.

Neste texto, vamos falar sobre essas coisas de forma simples e direta. Vamos ajudar casais a entenderem melhor o que acontece quando estão pensando em se separar ou voltar a ficar juntos. Queremos que eles tomem decisões com consciência, sabendo o que estão fazendo e o que pode acontecer depois.

“Se eu me arrepender, posso desistir do divórcio? Podemos reconciliar e pedir a anulação do casamento ou temos que casar novamente?”

Veja bem, para respondermos tais questionamentos precisamos primeiro diferenciar em qual momento nos encontramos no processo de separação, já que existem diferenças da situação em que o casal já está divorciado de fato e daquela em que o processo ainda se encontra pendente.

O divórcio já foi decretado, como que fica agora?

Devemos deixar claro que se o divórcio já tiver sido formalizado em definitivo, seja por sentença judicial transitada em julgado (quando não couber mais recursos dessa decisão e ela se torna de fato imutável), seja por celebração de escritura pública (no caso de extrajudicial), não haverá mais a possibilidade de voltar atrás, uma vez que estará dissolvido, por completo, o vínculo matrimonial.

Nesta situação, por já ter sido extinto, em havendo arrependimento e interesse em reconciliação, o casal deverá necessariamente realizar um novo casamento para voltar a ostentar o estado civil de ‘casados’.

Posso pedir Anulação do divórcio?

Via de regra, no caso de arrependimento, podemos afirmar que não é possível se anular o divórcio. 

Fica a ressalva, contudo, de que a depender do caso em concreto a sentença poderá ser anulada em decorrência de determinados vícios devidamente comprovados (erros irreparáveis e devidamente comprovados), como um vício de consentimento, quando uma das partes foi coagida a assinar o divórcio ou não tinha pleno discernimento para entender o que estava fazendo, por exemplo.

E se a ação de divórcio ainda estiver em curso, posso Desistir?

No caso da ação de divórcio ainda estiver em trâmite, a situação é diferente, já que, assim como toda e qualquer ação judicial, a parte que propõe o processo pode pedir a desistência da ação, desde que a outra parte não tenha sido citada (chamada para se defender), isto é, não tenha tomado conhecimento dessa ação oficialmente. No entanto, caso a parte contrária já tenha sido citada, ela necessariamente precisará se manifestar expressamente concordando acerca desta desistência.

Noutro lado, no caso de reconciliação dos interessados, havendo pedido formulado de forma consensual por ambas as partes, mesmo que após a sentença de decretação do divórcio, desde que não tenha havido o trânsito em julgado desta, é possível e recomendável a homologação da desistência da ação, mesmo porque a Justiça, nesta hipótese, não pode impedir a desistência do divórcio, muito menos a reconciliação do casal.

Nesse sentido, cito brilhante ponderação traçada pelo Desembargador Sérgio Fernandes Martins do Tribunal de Justiça do Mato Grosso do Sul, quando do julgamento de caso semelhante ao citado acima:

“….manter-se uma sentença de divórcio por questões processuais quando ambos os cônjuges confirmam ter retomado a vida a dois significa apegar-se demasiadamente a formalismos, em um inequívoco exemplo de esquecimento da regra básica de que o processo é apenas um meio para atingir um fim e não um fim em si mesmo. Não se pode olvidar que a atividade jurisdicional cumpre seu papel ao dirimir os conflitos trazidos pelos cidadãos que batem às portas do Judiciário, contudo neste caso, não há mais conflito a ser dirimido. A contrário, caso se consolide a situação contida nos autos – dissolução do casamento que não mais encontra substrato no mundo dos fatos -, o Judiciário estará, em verdade, potencializando o surgimento de novos conflitos”.

É importante destacar que, se o casal decidir parar o processo de Divórcio antes que todas as questões sejam resolvidas, isso significa que o tribunal não vai analisar a fundo os motivos da separação ou os pedidos que foram feitos. Em outras palavras, eles não vão decidir quem fica com o quê, como a guarda dos filhos, divisão de bens, pensão alimentícia, entre outros assuntos.

No entanto, essa decisão de desistir do processo agora não impede que o casal possa, mais tarde, iniciar um novo processo de Divórcio, se for necessário. Por exemplo, se eles ainda não chegaram a um acordo sobre como dividir as coisas ou sobre a guarda dos filhos, podem retomar o processo no futuro para resolver essas questões.

Em resumo, desistir do processo agora não significa que a separação está totalmente decidida, e eles podem voltar a tratar desses assuntos legalmente mais tarde, se for preciso. É importante entender que essa decisão pode ser tomada, mas é fundamental contar com a orientação de um advogado para entender todas as implicações legais e para tomar a melhor decisão para a situação deles.
