Quando um casal decide se divorciar, uma das questões que geralmente surge é a partilha dos bens adquiridos durante o casamento.

Entre esses bens, muitas vezes está a previdência privada, um instrumento financeiro que tem como objetivo a complementação de renda na fase final da vida.

No entanto, é importante compreender que a inclusão desse tipo de investimento na partilha dependerá do tipo de plano contratado.

Vamos entender melhor:

O que é Previdência Privada?

Inicialmente, a previdência complementar privada trata-se de um sistema criado para auxiliar as pessoas na construção de uma reserva financeira para a aposentadoria, além daquela já oferecida pelo Regime Geral (INSS) ou pelo Regime Próprio (no caso de servidores públicos).

A ideia é garantir uma renda adicional no momento em que a pessoa deixa de trabalhar, proporcionando uma maior estabilidade financeira e qualidade de vida na terceira idade.

Existem dois tipos principais de previdência privada:

Previdência Complementar Privada Fechada:

De um lado, o Plano de Previdência Fechada, os conhecidos “fundos de pensão”, é aquele ofertado a um grupo específico de pessoas, de determinada empresa particular ou órgão público, por exemplo.

Neste plano, normalmente, o beneficiário não consegue sacar os recursos antecipadamente, ou seja, precisa esperar a aposentadoria ou o desligamento da empresa para que possa ter acesso ao fundo

Geralmente, esse tipo de previdência não pode ser resgatado antecipadamente e segue regras mais rígidas, assemelhando-se à previdência social, possuindo, assim, caráter essencialmente previdenciário.

Previdência Complementar Privada Aberta:

Noutro lado, os Planos de Previdência Aberta são aqueles mantidos por instituições financeiras, corretoras de investimentos ou seguradoras e podem ser contratados por qualquer pessoa, os conhecidos PGBL e VGLB.

Aqui estamos diante de regime de capitalização no qual cabe ao investidor, com ampla liberdade e flexibilidade, deliberar sobre os valores de contribuição, depósitos adicionais, resgates antecipados ou parceladamente até o fim da vida, razão pela qual a sua natureza jurídica ora se assemelha a um seguro previdenciário adicional, ora se assemelha a um investimento ou aplicação financeira.

Neste contexto, oportuno conhecer as duas fases deste tipo de plano.

A primeira delas, se caracteriza pela fase de ‘formação de capital’, onde o investidor mensalmente realiza os aportes financeiros para no futuro literalmente formar o capital para ser convertido em uma ‘aposentadoria complementar’, aqui, diante do poder de liberdade do investidor (seja ao realizar os aportes como bem entender ou até mesmo sacar valores antecipadamente), estamos aqui diante de uma natureza de investimento.

Num segundo momento, após a formação do capital, temos a fase de recebimento, literalmente do gozo da aposentadoria complementar (seja em parcela única ou mensal, vitalícia ou não), aqui a natureza, assim como na previdência fechada, é eminentemente previdenciária.

E como ficam, então, os valores depositados na Previdência Privada no caso de Divórcio?

O principal fator que vai determinar se a previdência privada vai entrar na partilha de bens é o tipo de plano contratado, que pode ser fechado ou aberto.

Ao falarmos da previdência complementar FECHADA, diante das características semelhantes à previdência social, por expressa disposição legal (art. 1.659, VII do Código Civil) não compõe a partilha de bens no caso de divórcio.

De outro lado, o valor existente em plano de previdência complementar ABERTA, antes de sua conversão em renda e pensionamento ao titular (fase de formação de capital), possui natureza de aplicação e investimento, devendo ser objeto de partilha por ocasião da dissolução do vínculo conjugal.

Obs. caso o participante da previdência aberta já esteja recebendo os valores a título de PENSÃO, os valores passam a ter natureza previdenciária e, como na fechada, não integram o rol de bens a serem partilhados na separação.

Portanto, é fundamental que as partes envolvidas no divórcio estejam cientes do tipo de previdência privada contratada e busquem o auxílio de um profissional do direito especializado em família para analisar as particularidades de cada caso.
