O divórcio é um processo difícil para todas as partes envolvidas, principalmente quando há filhos menores de idade envolvidos no meio.

“Quem fica com a guarda dos filhos após o divórcio?” Essa é uma das perguntas mais comuns em processos de divórcio, e a resposta pode variar dependendo de diversos fatores, como a idade dos filhos, a capacidade dos pais de cuidarem deles, entre outros. No entanto, uma crença popular que ainda persiste é de que, automaticamente, a guarda dos filhos é sempre da mãe. Mas será que isso é verdade?

A resposta é não. Atualmente, no Brasil, a guarda é definida pelo melhor interesse da criança e não há predileção pela mãe ou pelo pai. Vamos entender melhor como funciona:

A guarda é o direito e o dever de cuidar, zelar e responsabilizar-se pela criança, podendo ser unilateral, compartilhada ou alternada. Na guarda unilateral, apenas um dos pais é responsável pela criança, enquanto na compartilhada ambos os pais possuem responsabilidades iguais, mesmo que ela fixe residência em apenas um dos genitores. Já na guarda alternada, a criança alterna a convivência com os pais de maneira fixa e preestabelecida, todavia, é importante destacar que esta não é regulamentada nem prevista na legislação brasileira.

A guarda unilateral era adotada como regra anteriormente, mas a partir da publicação da Lei nº. 13.058 em 2014, o Código Civil Brasileiro passou a estabelecer expressamente que a guarda dos filhos será compartilhada, como regra. A lei estabelece que a guarda compartilhada deve ser considerada como a mais adequada aos interesses da criança, exceto nos casos em que um dos pais abdica desse direito ou quando há problemas de saúde ou segurança da criança.

Desta forma, salvo casos excepcionais, em princípio, após o divórcio, ambos os pais serão responsáveis pela educação e cuidados dos filhos que tiverem em comum, devendo exercer em conjunto os direitos e deveres próprios da paternidade e maternidade, ainda que não vivam na mesma residência.

A guarda compartilhada é uma forma de garantir a participação de ambos os pais na vida da criança, garantindo o direito de convivência com ambos e a manutenção do vínculo afetivo. Isso é essencial para o desenvolvimento saudável da criança, que precisa de referências paternas e maternas para crescer equilibrada emocionalmente.

É importante destacar que a busca pelo melhor interesse da criança é o principal critério para a definição da guarda. Isso significa que não há predileção pela mãe ou pelo pai. O juiz deve analisar as condições dos pais, as necessidades da criança e o contexto em que ela está inserida para definir qual é a melhor opção para a guarda.

É importante lembrar que a guarda não é um direito dos pais, mas sim da criança. A criança tem o direito de ser cuidada e protegida por ambos os pais, desde que isso seja possível e viável. Portanto, a disputa pela guarda deve sempre levar em consideração o melhor interesse da criança e não a vontade dos pais, ok?

Em casos de disputa pela guarda, é comum que os pais recorram à Justiça. O juiz irá analisar as condições dos pais, as necessidades da criança e o contexto em que ela está inserida para tomar uma decisão. É importante que os pais apresentem provas e evidências que possam comprovar suas condições de cuidar da criança, como laudos psicológicos, testemunhas e documentos.

É pertinente destacar, por fim, que, independente de com quem a criança ficar na época da separação do casal, a fixação da sua guarda nunca é uma decisão definitiva e imutável. Caso as circunstâncias se alterem, como uma mudança de cidade ou de emprego de um dos genitores, caso haja interesse entre os envolvidos ou até mesmo caso existam circunstâncias que desaconselhem a permanência da criança com o detentor da guarda, como, por exemplo, quando há ocorrência de violência ou maus-tratos, saiba que a guarda pode ser revista a qualquer tempo para garantir que seja sempre a mais adequada ao interesse do menor.

É essencial lembrar que o interesse da criança deve ser sempre o foco principal nesses casos, e qualquer decisão deve ser tomada tendo em vista a proteção do seu bem-estar físico, emocional e psicológico.

Portanto, é fundamental que os pais estejam dispostos a dialogar e a colaborar entre si, sempre em prol do bem-estar dos filhos, e que a Justiça esteja sempre pronta para intervir quando necessário, garantindo a proteção dos direitos das crianças e adolescentes envolvidos.
