Após a decretação do divórcio, muitas pessoas ficam confusas sobre o que fazer em relação a questões práticas e jurídicas que envolvem o fim do casamento.

É importante lembrar que essa é uma etapa que exige alguns cuidados e providências para garantir a segurança e o bem-estar das partes envolvidas.

Desta forma seguem algumas dicas do que fazer assim que sair o divórcio de forma definitiva.

Obs. Lembrando que, no caso da modalidade judicial do divórcio, estamos falando da situação após o encerramento do processo de divórcio, uma vez que a sentença final tenha sido proferida e não haja mais recursos possíveis, ocasião em que a decisão judicial se tornará definitiva e irrecorrível e é considerada transitada em julgado. Salvo, hipóteses excepcionais de concessão liminar do divórcio – que deixaremos para abordar em outro artigo – é apenas aqui, com o trânsito em julgado, que o cumprimento da decisão final passará a ser devido já que não haverá mais possibilidade de mudá-la através de recursos judiciais.

* Averbação do Divórcio

Pois bem, encerrado o processo, é hora de dar efetividade às alterações decorrentes do fim do relacionamento, de antemão é bom lembrar que tudo começa com a averbação do divórcio, que nada mais é do que a anotação na certidão de casamento originário do encerramento do matrimônio, ocasião em que se tornará pública perante terceiros a nova situação do casal, oficializará o novo estado civil (divorciado) e anotará a mudança de nome, quando for o caso.

No caso de divórcio judicial, geralmente o próprio juiz responsável já emitirá ordem, ao final do processo, direcionada ao Cartório de Registro Civil que registrou o casamento para providenciar a respectiva anotação; caso não ocorra cabe às partes assim providenciarem. Já no caso do extrajudicial, como não há intervenção do judiciário, um dos recém-divorciados precisará levar a escritura pública do divórcio ao Cartório responsável e solicitar a averbação.

Obs. A falta da averbação não anula o divórcio, apenas oficializa o divórcio que já foi feito, ok? Para entender melhor a respeito da averbação clique aqui e confira o artigo completo sobre o tema.

* Alteração dos Documentos Pessoais

Conferidas as formalidades e pagando as taxas cartorárias, após a averbação você receberá uma certidão de casamento atualizada na qual estará devidamente averbado o seu divórcio.

Com a certidão em mãos, caso opte por retornar a usar o nome de solteira e excluir o sobrenome do cônjuge, você precisará providenciar a alteração dos documentos pessoais, aqui falamos de CPF, RG, carteira de motorista (CNH) e documentos bancários, por exemplo, para que estes estejam em conformidade com a nova situação civil da pessoa e com a atualização da nomenclatura.

Caso haja filhos menores envolvidos no processo, é importante lembrar de atualizar também a documentação deles, como RG e certidões de nascimento.

* Adequação da titularidade de Bens e Propriedades

Agora quanto aos bens, depois de efetivada a partilha, pagas as custas finais do processo e eventuais impostos quando houver – clique aqui para entender melhor quais impostos podem incidir em seu divórcio -, deve-se fazer o devido registro junto aos órgãos competentes para regularização das titularidades dos bens, falamos aqui de registros junto aos DETRANs (no caso de automóveis), aos Cartórios de Registros Imobiliários (no caso de imóveis) e Juntas Comerciais (no caso de cotas empresariais), por exemplo.

Os registros aqui não se darão de forma automática, neste caso cabe aos interessados solicitarem ao juiz do processo a emissão da chamada Carta de Sentença (também conhecida como Formal de Partilha) para depois tomarem as devidas providências para a finalização efetiva do divórcio.

Obs. tecnicamente não há prazo para o registro deste formal de partilha, mas é sempre importante manter os títulos de propriedade atualizados para se evitar confusão patrimonial e/ou quaisquer conflitos de interesses, por exemplo.

* Ajustar as Questões Financeiras

Outra providência importante é ajustar as questões financeiras decorrentes do fim do casamento, como a pensão alimentícia dos filhos, eventuais alimentos dos cônjuges e outros acordos financeiros que, por ventura, tenham sido estabelecidos.

É importante que as partes envolvidas cumpram com as obrigações previstas no acordo, para evitar problemas jurídicos e desgastes emocionais futuros.

* Revisar e Revogar Testamentos e Procurações

Em muitos casos, é comum que os cônjuges tenham feito testamentos e procurações em favor um do outro. Logo depois do divórcio, é importante revisar esses documentos para garantir que eles reflitam a nova situação civil das partes e evitar problemas jurídicos futuros.

Como podemos ver, há diversas providências a serem tomadas logo após a decretação do divórcio, tanto do ponto de vista prático quanto jurídico. É importante que as partes envolvidas se organizem e busquem auxílio jurídico, caso necessário, para garantir que todos os aspectos legais envolvidos na situação estejam devidamente ajustados e as partes possam, com segurança, seguir em frente.
