Quando um casamento chega ao fim, um dos aspectos mais delicados é a partilha dos bens adquiridos durante a união.

No Brasil, o regime mais adotado é o da Comunhão Parcial de Bens, no qual, em regra, os bens obtidos durante o casamento se comunicam entre os cônjuges e são divididos igualmente, independentemente de um cônjuge ter contribuído financeiramente mais do que o outro.

Isso ocorre porque, no regime de comunhão parcial de bens, parte-se do pressuposto implícito de que houve um esforço conjunto dos cônjuges para adquirir o patrimônio durante o casamento.

No entanto, é importante ressaltar que existem situações em que essa regra não se aplica. Tais EXCEÇÕES estão claramente estabelecidas no artigo 1.659 do Código Civil.

Vamos entende-las melhor:

I – Os bens que cada cônjuge possuir ao casar, e os que lhe sobrevierem, na constância do casamento, por doação ou sucessão, e os sub-rogados em seu lugar:

 Isso significa que os bens que cada cônjuge possuía antes do casamento, assim como aqueles recebidos por meio de doação ou herança durante o matrimônio, não entram na partilha.

Aqui estamos falando especificamente dos bens particulares, por exemplo, se um dos cônjuges já possuía uma casa antes do casamento, ela continuará sendo de sua propriedade exclusiva mesmo após o enlace matrimonial.

Também destacamos aqui que bens recebidos por herança ou doação também serão considerados como bens particulares e, por consequência, também não entrarão na partilha.

II – Os bens adquiridos com valores exclusivamente pertencentes a um dos cônjuges em sub-rogação dos bens particulares:

Nesse caso, se um cônjuge utiliza seus recursos financeiros próprios (adquiridos antes do relacionamento) para comprar um determinado bem, como um imóvel, esse bem será considerado como particular dele e não entrará na partilha.

Da mesma forma aqui, se cônjuge vender esse imóvel e adquirir outro com o dinheiro proveniente da venda do primeiro, esse novo imóvel também não entrará na partilha de bens, vez que incomunicável por também ser considerado particular, é o que chamamos de sub-rogação.

III – As obrigações anteriores ao casamento:

As dívidas e obrigações assumidas individualmente por cada cônjuge antes do casamento não serão obviamente partilhadas, sendo, a princípio, a responsabilidade por elas exclusivamente por quem as contraiu.

Falamos aqui das dívidas como empréstimos, consignados, consórcios ou financiamentos, por exemplo

Vale lembrar que, no caso do financiamento, se houver prestações adimplidas no transcurso do relacionamento, tal adimplemento é presumido como proveniente de esforço comum e entrará, por óbvio, proporcionalmente na partilha.

IV – As obrigações provenientes de atos ilícitos, salvo reversão em proveito do casal:

Caso um dos cônjuges tenha cometido algum ato ilícito, como fraude ou crime, e seja condenado a pagar uma indenização, esse ônus não será compartilhado pelo outro cônjuge.

No entanto, se houver uma reversão em proveito do casal, ou seja, se o dinheiro da indenização for usado para benefício dos dois, então essa quantia entrará, por razões óbvias, na partilha.

V – Os bens de uso pessoal, os livros e instrumentos de profissão:

Itens como roupas, acessórios pessoais, livros e instrumentos de trabalho são considerados bens de uso pessoal e não entram na partilha.

Por exemplo, se um cônjuge é médico e possui instrumentos cirúrgicos ou equipamentos específicos para sua profissão, eles serão de sua propriedade exclusiva.

VI – Os proventos do trabalho pessoal de cada cônjuge:

Os salários e rendimentos obtidos individualmente por cada cônjuge durante o casamento não são partilhados, sendo que cada cônjuge possuirá direito aos frutos de seu próprio trabalho.

VII – As pensões, meios-soldos, montepios e outras rendas semelhantes:

Da mesma forma ao artigo anterior, benefícios como pensões, aposentadorias e outras rendas de natureza similar não são considerados bens a serem partilhados. Eles permanecem como propriedade exclusiva do cônjuge que os recebe.

 

Conclusão

Nota-se que essas exceções têm o objetivo de preservar o patrimônio individual de cada cônjuge, reconhecendo situações em que não houve uma contribuição conjunta para a aquisição do bem ou em que o bem tem uma natureza pessoal específica.

Em suma, embora a comunhão parcial de bens seja o regime mais comum nos casamentos brasileiros, é importante estar ciente das exceções previstas no artigo 1.659 do Código Civil. Essas exceções protegem o patrimônio individual de cada cônjuge, respeitando situações em que houve aquisições particulares, dívidas anteriores ao casamento, obrigações ilícitas, entre outros. Conhecer seus direitos é essencial para que a divisão dos bens seja justa e equilibrada.
