Como se sabe, a pensão alimentícia é um instituto jurídico que visa garantir o sustento do filho menor de idade quando há uma separação ou divórcio dos pais.

O valor e a forma de pagamento são estabelecidos pelo juiz, como dito, com base nas necessidades do filho e nas possibilidades financeiras dos pais e, em geral, a pensão é depositada na conta do genitor que detém a guarda, que acaba sendo o total responsável por administrar tais recursos em benefício do filho menor de idade.

Tomemos como base uma situação hipotética de que, após o divórcio, a mãe tenha ficado com a guarda do filho menor do casal e, portanto, os valores de pensão alimentícia acabam sendo depositados em conta bancária de sua titularidade e ela se torna a única responsável pela gestão de tais valores.

No entanto, na prática, não é raro surgir questionamentos e suspeitas da parte que paga os valores acerca de como tal dinheiro acaba sendo gasto diariamente e é aí que é comum surgir a seguinte dúvida: “posso exigir uma prestação de contas da mãe?”

Afinal, o pai que paga a pensão pode exigir prestação de contas?

Como visto, com o pagamento das pensões presume-se que a mãe, como detentora da guarda da criança, está em melhor posição para satisfazer suas necessidades efetivas.

Dentro desse contexto, é importante ressaltar que, em regra, NÃO é possível exigir prestação de contas da mãe em relação à pensão alimentícia despendida com o filho.

Isso ocorre porque a administração dos recursos repassados ao detentor da guarda é de exclusiva responsabilidade deste último. Ficando a mãe, no caso, com o dever de utilizar o dinheiro para prover as necessidades do filho, seja com alimentação, lazer, remédios ou qualquer outra despesa essencial.

Dessa forma, não cabe ao pai questionar a forma como a mãe está administrando os recursos, uma vez que essa é uma incumbência exclusiva dela.

Os tribunais brasileiros, em especial o Superior Tribunal de Justiça (STJ), já têm se posicionado de forma constante no sentido de que a ação de prestação de contas não é permitida, em regra, no âmbito das ações de alimentos, sendo aceita em situações extremamente excepcionais, donde, diante das peculiaridades específicas do caso em concreto, haja indícios concretos de mau uso das verbas alimentares, ou seja, quando há evidências de que o dinheiro não está sendo utilizado para as necessidades do filho.

A título exemplificativo, um caso em que o próprio STJ reconheceu a prestação de contas como devidas, envolveu a situação de pensões alimentícias que eram pagas nos patamares entre R$7 a 10 mil, mas por relatos do genitor constatou-se que muita das vezes encontrava os filhos gêmeos com roupas rasgadas, carentes de higiene pessoal, com material escolar danificado, o que era, evidentemente, incompatível com o montante despendido a título de alimentos aos menores.

Vale o destaque de que ações judiciais por mero capricho ou perseguição por parte do genitor responsável pelo pagamento das pensões, algo que não é raro na esfera das relações íntimas familiares, devem ser coibidas e, de toda forma, evitadas pelo Judiciário, na medida em que não podem (nem devem) servirem de intuito exclusivo de importunação do administrador dos alimentos.

Qual a via adequada para questionamentos então?

Por mais que o pedido de prestação de contas seja aceito apenas em situações excepcionalíssimas, como explicado acima, caso o pai queira questionar o valor da pensão alimentícia ou suspeite de irregularidades no seu uso, a via adequada para questionar essa situação seria a ação revisional ou ação de modificação da guarda ou suspensão do poder familiar.

Essas ações permitem ao pai apresentar ao juiz novos elementos que justifiquem a revisão dos valores estabelecidos anteriormente ou até mesmo uma modificação nas responsabilidades de cada um dos genitores.

Conclusão

Em suma, é essencial saber equilibrar os direitos e deveres dos pais, garantindo a assistência adequada às crianças, sem abrir margem para ações judiciais desnecessárias e prejudiciais ao bem-estar dos envolvidos.

Em todas as circunstâncias, é fundamental que os pais envolvidos tenham sempre em mente o bem-estar e o interesse superior do filho como prioridade.
