A pensão alimentícia é um direito garantido por lei aos filhos menores, que visa garantir o sustento e a subsistência da criança ou adolescente após o divórcio ou separação dos pais. É uma obrigação legal imposta ao genitor que não detém a guarda da criança, independente de ter ou não a guarda compartilhada.

Ao contrário do que pode se pensar, a pensão alimentícia não se limita apenas ao pagamento das despesas dos alimentos propriamente ditos, mas deve ser suficiente para garantir todas as necessidades básicas do menor, como moradia, alimentação, lazer, transporte, vestuário, educação e saúde.

A fixação do valor da pensão alimentícia pode ser feita de forma consensual entre os pais, através de um acordo, ou judicialmente (em uma ação específica ou diretamente na ação de divórcio), caso não haja acordo entre as partes.

É importante que a fixação seja formalizada na via judicial (seja com a homologação do acordo ou por meio de decisão judicial, no caso de litígio) para se tornar uma obrigação legalmente exigível e viabilizar a cobrança, no caso de inadimplência ou atrasos no pagamento, por exemplo.

A definição do valor é realizada com base no binômio necessidade do alimentado e possibilidade do alimentante, motivo pelo qual em uma eventual ação de alimentos será necessário apresentar documentos que comprovem as despesas do filho assim como as possibilidades financeiras do genitor que irá pagar a pensão.

Inobstante não haver um valor fixo pré-estabelecido por lei, observa-se de uma maneira geral, que o Judiciário costuma fixar a pensão alimentícia corresponde a um percentual sobre a renda líquida do responsável que não detém a guarda podendo variar de 10 a 30%, mas sempre alertando que cada caso deve ser analisado conforme as peculiaridades e individualidades dos envolvidos, podendo, por óbvio, esses valores serem maiores ou menores que os aqui referenciados.

Vale destacar que a pensão alimentícia pode ser reajustada sempre que houver mudança na situação financeira dos pais ou nas necessidades do filho, mas fica o alerta de que essa revisão deve sempre (assim como na fixação) ser registrada judicialmente, mesmo no caso de acordo.

É importante ressaltar que a pensão alimentícia é uma obrigação dos pais em relação aos filhos menores, ou seja, aqueles que ainda não completaram 18 anos de idade. No entanto, a obrigação de prestar alimentos pode se estender para além da maioridade do filho, desde que este ainda esteja estudando e não tenha condições de prover o próprio sustento.

Obs.  Em casos de filhos incapazes ou com necessidades especiais, a pensão alimentícia pode ser mantida por tempo indeterminado.

Em casos de inadimplência no pagamento da pensão alimentícia, é possível entrar com uma ação de execução de alimentos, que tem como objetivo garantir o cumprimento da obrigação alimentar. O não pagamento da pensão alimentícia pode levar à prisão civil do devedor, bloqueio de contas bancárias e penhora de bens, por exemplo. Por isso, é fundamental que os pais cumpram com sua obrigação de prestar alimentos aos filhos.

Vale ressaltar que a pensão alimentícia não deve ser vista como um fardo ou obrigação, mas sim como uma forma de garantir o bem-estar e a subsistência dos filhos. É uma obrigação legal e moral do responsável que não detém a guarda, que deve ser cumprida de forma regular e pontual.
