No entanto, muitas vezes, surge a dúvida sobre a possibilidade de descontar a pensão alimentícia diretamente no salário do devedor. Vamos entender como ela funciona e em quais casos é permitida.

Pensão Alimentícia: o que é e como é fixada

Antes de tudo, pertinente lembrarmos que a pensão alimentícia é um valor estabelecido judicialmente (seja pela homologação do acordo entre as partes seja por decisão judicial propriamente dita), sempre destinado a suprir as necessidades básicas do alimentado, como alimentação, moradia, educação, saúde, entre outros.

Sua fixação, pode se dar, via de regra, de duas formas distintas. A primeira delas é por meio de um valor fixo mensal estabelecido pelo juiz, levando em consideração as necessidades da criança ou adolescente e as possibilidades financeiras do alimentante. Essa modalidade proporciona uma previsibilidade para ambas as partes, garantindo um valor constante a ser pago regularmente.

Já a segunda forma é a fixação da pensão alimentícia de forma proporcional ao salário do devedor, o que significa que o valor a ser pago será calculado com base em um percentual do rendimento mensal do alimentante. Essa vinculação ao salário pode ser estabelecida para garantir uma contribuição condizente com a capacidade financeira do devedor, assegurando que o montante da pensão se ajuste às variações de sua renda.

Possibilidade de Desconto em Folha de Pagamento:

Independente da forma como a pensão alimentícia for fixada, a legislação autoriza expressamente o desconto dos valores diretamente no salário do devedor.

Essa medida tem como finalidade principal garantir o cumprimento efetivo da obrigação alimentar e prevenir a inadimplência recorrente.

A lei permite que a pensão alimentícia seja descontada diretamente do salário do responsável. Isso significa que o valor devido é retirado do salário antes mesmo de ele receber o dinheiro. Essa medida é respaldada pela legislação e tem o objetivo de garantir o pagamento regular da pensão, evitando atrasos e problemas financeiros. Dessa forma, o valor é descontado automaticamente do salário, assegurando que o beneficiário receba o que lhe é devido.

Obs. esta possibilidade abrange tanto funcionários públicos, militares, diretores ou gerentes de empresa ou empregados sujeito à legislação do trabalho (CLT).

No entanto, é importante ressaltar que essa modalidade de desconto só ocorre por determinação judicial, caso o juiz responsável considerando pertinente diante das particularidades e circunstâncias envolvidas.

Qual o valor do desconto?

Os valores de desconto irão sempre depender do que restar decidido judicialmente e irão variar conforme as peculiaridades de cada caso.

Lembrando aqui que o valor considerado para fins de cálculo da pensão alimentícia será sempre o bruto descontado as deduções obrigatórias, como imposto de renda e contribuições previdenciárias.

A incidência em demais verbas, como décimo terceiro e adicional de férias, por exemplo, devem constar expressamente na decisão judicial.

Como o desconto é efetuado?

A legislação já determina que, a mesma decisão que determinar o desconto da pensão alimentícia no salário do devedor, já solicite a emissão de um ofício endereçado ao empregador do responsável detalhando todas as informações necessárias para que a empresa possa efetuar o desconto corretamente.

Esse documento deve conter dados como o valor da pensão, a forma de cálculo, a identificação do alimentado, o prazo para o desconto, incidência ou não em verbas de décimo terceiro salário e adicional de férias, entre outras informações relevantes.

Os descontos passam a valer a partir da primeira remuneração posterior do executado, a contar do protocolo do ofício.

Mas e se a empresa, mesmo notificada, não cumprir?

Caso a empresa não cumpra a determinação judicial de desconto da pensão alimentícia no salário, ela estará sujeita às consequências legais, inclusive na esfera penal.

Constitui a prática de crime contra a Administração da Justiça (art. 22 da Lei 5.478/68) o fato de deixar o empregador ou funcionário público de prestar ao Juízo competente as informações necessárias à instrução de processo ou execução de sentença ou acordo que fixe pensão alimentícia; passível de pena de detenção de 6 meses a 1 ano.

Apenas valores atuais podem ser descontados?

Não, além das parcelas mensais que ainda estão sendo cobradas já há um entendimento pacífico nos nossos Tribunais de que as pensões em atraso também poderão descontadas da folha de pagamento do devedor.

O Superior Tribunal de Justiça (STJ) entende que isso pode ser feito, desde que seja em montante razoável e de modo que não impeça a própria subsistência do alimentante, a legislação determina que o juiz não desconte mais de 50% do salário do empregado.

Conclusão

Desta forma, o desconto da pensão alimentícia no salário do devedor é uma medida importante para assegurar o cumprimento da obrigação alimentar de forma mais efetiva. No entanto, é fundamental lembrar que essa medida só pode ser determinada pelo juiz, mediante decisão judicial.
