As pensões alimentícias aos filhos menores são valores que os pais são obrigados a pagar para garantir o sustento, a educação e a saúde dos seus filhos até que atinjam a maioridade ou, em alguns casos, até a conclusão dos estudos. É comum que, ao fixar o valor da pensão alimentícia, o juiz leve em consideração o padrão de vida da família antes da separação, as necessidades dos filhos e a capacidade financeira dos pais.

Desta forma, o valor pode ser fixado em um valor fixo ou em um percentual sobre o salário do pai – como já explorado em detalhes em outro artigo neste blog.

Mas a pergunta que geralmente fica é: “o valor vai ser sempre o mesmo?”

Não! Independente da forma como for fixada, a pensão pode ser reajustada para garantir que o valor pago continue sendo suficiente para atender às necessidades dos filhos, mas a depender da situação o reajuste será diferente. Vamos entender melhor..

No caso de pensão estipulada em um valor pré-fixado como R$300,00; R$500,00 ou R$1.000,00, por exemplo, o ideal é que o acordo ou a decisão judicial já indique o índice oficial de inflação a ser aplicado (IGPM, INPC, IPCA, etc..).

O que geralmente costumamos ver na prática, é que geralmente o valor fixado já é atrelado a um percentual do próprio salário-mínimo, ocasião em que, com a cada aumento do salário-mínimo a pensão será automaticamente atualizada, seguindo o mesmo reajuste.

De outra forma, no caso da pensão ter sido estabelecida com base em um percentual sobre o salário do genitor, por óbvio, os reajustes serão devidos caso o salário sofra alguma alteração.

Obs. em qualquer caso, o reajuste pode ser positivo (para aumentar os valores) ou negativos (para diminuir os valores), a depender do índice aplicado ou do reajuste do salário do genitor.

Novo Salário-Mínimo em 2023:

A Medida Provisória de nº. 1.172/2023, publicada em abril de 2023, estabeleceu um novo valor para o salário mínimo, que passará a ser de R$ 1.320,00 (um mil, trezentos e vinte reais) a partir de maio de 2023.

Como visto, esse reajuste impactará diretamente no valor das pensões alimentícias que foram fixadas com base em um percentual do salário-mínimo.

Portanto, se você recebe ou paga a pensão alimentícia em percentual do salário mínimo, é necessário calcular o novo valor, já que o reajuste neste caso é automático.

Geralmente o salário mínimo é reajustado no mês de janeiro de cada ano, mas também pode ocorrer em outra data ou mais de uma vez ao ano, como ocorreu neste ano de 2023, por isso é preciso sempre ficar atento aos novos valores e efetuar o pagamento da pensão alimentícia corretamente!
