Maria e seu marido, João, compraram um imóvel após se casarem e passaram a residir lá juntos. Porém, após alguns anos, eles acabaram brigando, ocasião em que João vai embora e abandona a casa, deixando Maria morando e arcando com todos os custos dela literalmente sozinha.

Você sabia que nesta situação, Maria pode, desde que preenchido alguns requisitos legais, garantir a propriedade da casa para ela através da usucapião? Vamos entender melhor:

O que é Usucapião?

De uma maneira bem direta, usucapião é um processo pelo qual uma pessoa pode adquirir a propriedade de um bem (como uma casa ou um terreno, por exemplo) por meio de seu uso contínuo e pacífico por um determinado período de tempo sem oposições, mesmo que não seja oficialmente seu dono legal. Em outras palavras, se alguém mora em um imóvel por muitos anos sem ser incomodado e sem que o verdadeiro dono apareça para reivindicar a posse/propriedade, essa pessoa pode solicitar judicialmente que o imóvel passe a ser dela por meio da usucapião.

A ideia por trás desse instituto legal é que, se alguém utiliza um bem como se fosse seu, sem que o verdadeiro dono faça nada para impedir, é justo que essa pessoa adquira a propriedade do bem.

No entanto, é importante destacar que existem requisitos legais a serem cumpridos para que uma pessoa possa adquirir a propriedade por meio da usucapião, os quais variam bastante conforme o bem interessado e a situação em que o requerente se encontra.

O que é a Usucapião Familiar?

A usucapião familiar é uma modalidade específica de usucapião que pode ser utilizada exatamente no exemplo narrado acima, para que o possuidor de um imóvel compartilhado com seu ex-cônjuge ou ex-companheiro que abandonou o lar por alguns anos e não reivindicou seus direitos tenha domínio integral sobre o imóvel. 

“Aquele que nele permaneceu como possuidor, possibilitando a função social do bem, pagando tributos e praticando atos de conservação, é merecedor da propriedade total pelo uso do imóvel.” (DINIZ, Maria Helena. Curso de Direito Civil Brasileiro: direito das coisas. V.4. 28ª Ed. São Paulo: Saraiva, 2014).

Como dito acima, para que seja reconhecida a usucapião, é necessário preencher alguns requisitos previstos na lei, vejamos os requisitos específicos da usucapião familiar:

  • Que o casal tenha vínculo anterior de Casamento ou União Estável

Plenamente aplicável no caso de uniões homoafetivas;

Esta espécie de usucapião somente pode ser utilizada por cônjuge ou companheiro, aqui o direito não se estende a outros familiares mesmo que residam junto.

  • O imóvel seja Próprio, Urbano, Residencial e de Propriedade Comum entre o casal, comprovado por matrícula do imóvel em cartório;

Para esta modalidade de usucapião, os cônjuges precisam ser coproprietários do imóvel objeto da usucapião, já que a usucapião viabiliza a aquisição apenas da meação do outro cônjuge, parte que ele teria direito (50%) na partilha de bens caso não tivesse abandonado o lar;

O imóvel não pode ter financiamento com alienação fiduciária pendente (já que aqui o imóvel não é oficialmente do casal, mas sim da instituição financeira);

O imóvel não pode ser rural

  • O imóvel tenha no máximo 250 m²;

Aplicável para casas ou apartamentos, mas precisa ter alguma construção no imóvel (aqui não se aplicaria para terrenos, por exemplo).

  • O imóvel deve ser utilizado como Moradia pela pessoa e sua família;

O imóvel não pode ser alugado para terceiros ou utilizado para outros fins, senão o da moradia do interessado em adquiri-lo pela usucapião.

Desde que resida no imóvel, ele pode ter destinação mista (comercial e residencial), no caso em que a frente da casa é utilizada para a subsistência da família com um salão de beleza, conveniência ou restaurante por exemplo.

  • Abandono Voluntário do lar pelo ex-cônjuge coproprietário;

O abandono não pode ter sido em decorrência de ação judicial, como no caso de crime ou medida protetiva em virtude de violência doméstica por exemplo.

O abandono não é caracterizado apenas do afastamento meramente físico, quando uma das partes passa a residir em outro local após a separação, mas sim da total ausência de uma assistência moral e material à família. Ou seja, o ex-companheiro ou ex-cônjuge não pode prestar qualquer auxílio na manutenção da casa (como alimentos ou pagamento de impostos do imóvel, por exemplo) ou demonstrar interesse pelo imóvel durante o tempo de posse exclusiva pelo outro.

  • A posse do imóvel deve ser exercida de forma contínua e sem interrupção por pelo menos Dois Anos após o abandono do bem;

Não pode haver oposição ou ação judicial em relação ao imóvel pelo ex-cônjuge

A posse pode ser comprovada por documentos (como comprovantes de pagamento de tributos e insumos referentes a manutenção e conservação do imóvel pagos somente pela parte possuidora – IPTU, faturas de água, luz e internet, gastos com faxina, reformas e pinturas, por exemplo) e por testemunhas;

  • O requerente possuidor não pode possuir outro imóvel urbano ou rural em seu nome.

Esse ‘benefício’ da usucapião familiar não será concedido duas vezes a mesma pessoa

Em resumo são estes os requisitos da lei para utilização da usucapião familiar.

Vale ressaltar que se um destes critérios não forem obedecidos deixa de ser válida esta modalidade especial da usucapião. Porém, outras formas de usucapião continuarão igualmente válidas para se obter a propriedade, ocasião em que se precisará analisar outros requisitos a depender da modalidade pretendida (ordinária, extraordinária, rural, especial urbana, etc.)

Por fim, importante ressaltar que a usucapião familiar não é automática, deve ser requerida judicial ou administrativamente em cartório, mas sempre com o acompanhamento de um advogado especialista e, somente ao final do processo caso deferida, ocorrerá a emissão uma nova matrícula imobiliária com a regularização da propriedade do bem discutido.

Percebe-se, assim, que a usucapião familiar é um processo judicial complexo e que requer um acompanhamento jurídico adequado para evitar problemas futuros.
