O divórcio é um processo que pode ser difícil e complexo para muitas pessoas, e entender exatamente como ele funciona pode ajudar a tornar esse processo mais claro e menos estressante para todos os envolvidos.

Você sabia que há certas situações que o divórcio precisará ser necessariamente resolvido na Justiça?

Pois é, quando as partes não conseguirem chegar num acordo amigável sobre todos os termos da separação ou, quando mesmo de comum acordo, houver filhos menores ou incapazes envolvidos, a questão precisará ser resolvida por um juiz de direito por meio de uma Ação de Divórcio (o chamado DIVÓRCIO JUDICIAL).

Aqui, o juiz irá analisar todas as peculiaridades do caso em concreto e determinar os exatos termos a serem vigentes após o fim da relação matrimonial.

Dito isto, vamos entender, brevemente, como cada uma desta ocasiões funciona:

Divórcio Judicial Consensual

O consenso significa que todos os envolvidos estão de comum acordo, ou seja, que todos os termos do divórcio serão resolvidos amigavelmente.

Aqui, como dito, a via Judicial será necessária quando o casal a se divorciar tiver filhos menores ou incapazes, isso porque pela presença deles o Ministério Público será chamado para opinar, como fiscal da lei, e garantir que as escolhas tomadas em comum acordo pelos genitores (pai e mãe) sejam justas e preservem todos os direitos dos filhos.

Entenda que, o Ministério Público não irá atuar em favor de nenhuma das partes (nem do pai, nem da mãe), ele estará no processo para resguardar os interesses das crianças/adolescentes envolvidos! Então, a depender da situação, o promotor responsável poderá pedir a alteração nos termos do acordo ou até mesmo recorrer das decisões judiciais caso entenda que elas sejam prejudiciais aos menores, ok?

Então, o destaque principal neste tipo de situação fica para que, antes de ingressar com a ação judicial propriamente dita, as partes, em conjunto, estabeleçam todas as condições e termos do acordo de separação levando em consideração as necessidades dos filhos.

Ao falarmos de acordo, obviamente ele irá variar de acordo com as peculiaridades de cada caso, mas em suma deverá conter ao menos as informações como:

Vale também lembrar que, por ser amigável, ambas as partes ingressarão como autores da mesma ação e podem, portanto, escolher um único advogado para conduzir todas estas tratativas.

Obs. isso não as impede, caso assim não queiram, de cada um indicar um advogado da sua confiança para, ao final, assinarem em conjunto os termos do acordo.

Enfim, chegado no consenso e redigido a petição de acordo, ela será apresentada ao juiz competente, o qual, antes de decidir encaminhará para colher a opinião do Ministério Público e, posteriormente, se estiver tudo nos conformes legais, homologará as cláusulas propostas via sentença judicial, a qual passará a valer como lei entre os envolvidos.

Divórcio Judicial Litigioso

Ao contrário do consensual, aqui as partes não conseguiram resolver as questões de forma amigável, seja porque um dos envolvidos não concorda com o fim do relacionamento ou, mesmo que concorde com o divórcio, não chegaram a um denominador comum sobre os termos envolvidos nele (como ficarão os bens, dívidas, filhos, etc.).

Vale lembrar que, quando um dos envolvidos não quer mais manter o relacionamento ele não é obrigado a permanecer casado, ok? Este pedido de divórcio dispensa a apresentação de qualquer justificativa do interessado e é inclusive um pedido que a outra parte não pode se escusar, já que aqui o pedido de se separar independe de qualquer autorização ou concordância do outro.

Pois bem, como nesta modalidade os envolvidos não conseguiram resolver amigavelmente a situação (independente da existência de filhos do relacionamento ou não), cada um deverá eleger um advogado de sua confiança para defender seus motivos e seus pedidos.

Aqui um dos envolvidos (homem ou mulher) irá propor a ação e será, portanto, o autor. O outro, por sua vez, será citado para apresentar sua defesa, entrando no processo como réu.

A ação começará com a apresentação de uma petição inicial pelo autor, que irá apresentar sua versão dos fatos, indicar as questões que devem ser resolvidas pelo juiz (aquelas que não conseguiu se acertar de forma consensual) e pedir o divórcio.

Com a petição em mãos, o juiz, antes de tudo, analisará (quando houver) os pedidos urgentes (liminares), que, por óbvio, irão variar conforme as peculiaridades de cada caso concreto.

Superada essa fase, será designada uma audiência entre as partes para tentativa de solução amigável e pacificação dos assuntos.

Obs. Mesmo que o processo comece de forma litigiosa isso não impede as partes de entrarem num acordo durante o curso da ação, já que a própria legislação da preferência para a solução menos desgastante aos envolvidos. Aqui, a audiência será conduzida por um mediador ou conciliador, um profissional capacitado que conversará com as partes e os advogados na tentativa de apaziguar os ânimos e chegar a um denominador comum ao final do relacionamento.

Se houver acordo, o processo seguirá o trâmite como se consensual fosse e passará pela homologação do juiz. Agora quando, mesmo assim, não se chegar a um consenso, será aberto prazo para a parte contrária apresente sua defesa (contestação) com suas versões dos fatos e pedidos.

Após, ainda haverá uma fase de instrução de provas (onde poderá haver novas audiências, perícias, apresentação de novos docs., etc.) e, quando houver filhos menores/incapazes, o encaminhamento para oitiva do Ministério Público.

Ao final, o juiz irá tomar uma decisão sobre as questões em disputa e determinar todos os termos a serem vigentes no divórcio proposto, por meio de uma sentença.

Destaca-se que, caso as partes não concordem com o que fora decidido, a decisão pode ser desafiada por meio de recursos judiciais, onde o advogado solicitará sua revisão pelo 2º grau de jurisdição ou até mesmo aos Tribunais Superiores (STJ e STF).

É importante lembrar que o divórcio judicial é um processo que pode ser longo e complexo, e é recomendável que as partes envolvidas contem sempre com a ajuda de um advogado especializado em direito de família para orientá-las durante todo o processo.
