Vamos começar do começo: a pensão alimentícia é um direito fundamental que visa garantir que aqueles que não têm condições de se sustentar recebam os recursos necessários para viver dignamente. Geralmente, a pensão é estabelecida em casos de divórcio, separação, dissolução de união estável ou até mesmo quando há o reconhecimento judicial da paternidade.

Agora, me diga, o que você acha de alguém que foge dessa responsabilidade? Alguém que vira as costas para o bem-estar daqueles que dependem de sua contribuição? Parece justo? Pois é, também acho que não.

Quando alguém deixa de pagar a pensão, medidas podem ser tomadas para garantir que essa obrigação seja cumprida.

Inicialmente, é possível recorrer à via judicial para cobrar os valores atrasados. O juiz pode determinar a penhora de bens, bloqueio de contas bancárias e até mesmo o desconto direto na folha de pagamento do devedor. Afinal, é preciso fazer com que ele sinta o peso de suas ações.

Além disso, em casos extremos e recorrentes de inadimplência, quando a cobrança for relativa à dívidas atuais (as últimas três prestações), pode-se decretar inclusive a prisão civil do genitor devedor que pode durar até três meses em regime fechado.

Mas sabia que, quando a inadimplência da pensão alimentícia é injustificada, as consequências podem ir além da esfera cível e atingir até mesmo a esfera criminal?

Pois bem, a falta de pagamento da pensão alimentícia pode configurar um crime, conhecido como Abandono Material. Conforme previsto no artigo 244 do Código Penal, aquele que, sem justificativa, deixa de prover a subsistência de alguém que depende financeiramente dele pode ser penalmente responsabilizado.

As consequências criminais do abandono material são significativas. O infrator pode ser condenado a uma pena de detenção de um a quatro anos, além de estar sujeito ao pagamento de multa.

Pertinente se pontuar aqui que, ao tempo em que a prisão civil pode ser decretada já no início do processo quando constatado que o devedor, mesmo citado, não efetuou o pagamento dos débitos alimentares pendentes; uma eventual prisão penal o crime deverá ser apurado pelas autoridades competentes, após representação do interessado junto a polícia judiciária, sendo que o alimentando somente será responsabilizado após o devido tramite processual.

Mas fique atento! A doutrina já vem entendendo que, em havendo atraso ou não pagamento da verba alimentar e indícios de que o devedor dispõe de recursos econômicos, o juiz cientificará ao Ministério Público para apurar a prática do crime de abandono material (Enunciado 23/IBdFam).

Da mesma forma, uma vez constatado que o alimentante (devedor), mesmo dispondo de recursos econômicos, se utiliza de truques ou subterfúgios para não pagar ou para retardar o pagamento de verba alimentar, incorre na conduta descrita no art. 7º, inc. IV da Lei nº 11.340/2006, a chamada Violência Patrimonial – subespécie de violência doméstica (Enunciado 20/IBdFam).

Então, meu amigo, minha amiga, se você é alguém que está pensando em deixar de pagar a pensão alimentícia, eu sugiro fortemente que repense suas atitudes. Afinal, a lei está aí para garantir que as pessoas cumpram com suas responsabilidades e que os mais vulneráveis sejam protegidos.
