A Pensão será devida até quando?

No passado, era mais comum que o ex-marido pagasse alimentos à ex-mulher de forma vitalícia, já que, muitas vezes, ela se dedicava com exclusividade ao lar e filhos abandonando, por anos, qualquer potencial ingresso no mercado de trabalho, enquanto aquele contribuía financeiramente. Ocorre que hoje em dia, com a mulher cada vez mais inserida no mercado de trabalho, essa realidade já não é tão frequente assim.

Levando isso em consideração, o entendimento que vem predominando nos nossos Tribunais é o de que os alimentos devidos entre ex-cônjuges não podem servir de fomento ao ócio ou ao enriquecimento sem causa, motivo pelo qual devem ser fixados, em regra, com prazo determinado, ou seja, com data de início e fim!

Basicamente pode-se dizer que a pensão será fixada por tempo certo, com o fim específico de assegurar ao alimentado (ex-cônjuge), tempo suficiente para sua inserção, recolocação ou progressão no mercado de trabalho, que lhe possibilite manter pelas próprias forças e o status social similar ao período do relacionamento.

Fica aqui a ressalva de que, em situações específicas e devidamente comprovadas, no caso de circunstâncias de incapacidade laboral permanente, ou, ainda, quando se constatar a impossibilidade prática de inserção no mercado de trabalho, devido à idade avançada, por exemplo, ainda se pode cogitar, de forma EXCEPCIONAL, a pensão de forma vitalícia.
