A União Estável é uma forma de constituição de família reconhecida pela legislação brasileira, que se caracteriza pela convivência pública, contínua e duradoura entre duas pessoas, com intuito de constituir uma família.

Muitos casais optam por essa forma de convivência por diversos motivos, dentre os quais podemos destacar a liberdade de escolha. Ao contrário do casamento, que segue uma estrutura mais formal e rígida, a união estável é mais flexível em relação ao formato da relação e à sua organização.

Outro fator que leva os casais a optarem pela união estável é a possibilidade de construir uma vida em comum sem precisar seguir tradições ou formalidades impostas pela sociedade. Na união estável, os parceiros têm mais liberdade para construir sua relação de acordo com suas próprias expectativas e desejos, sem precisar se adequar a padrões pré-estabelecidos.

Porém, apesar de não precisar seguir as formalidades legais de registroo que já abordamos com mais detalhes em outro artigo-, é importante mencionar que a medida é de extrema relevância, vez que em existindo uma formalização via escritura pública de união estável não haveria qualquer desgaste ou necessidade de juntar provas para comprovar que a união existiu, sua data de início e/ou duração.

Enfim, independente do registro, uma vez identificada e configurada a União Estável, ela passa a gerar diversos reflexos tanto na esfera patrimonial quanto na esfera extrapatrimonial dos envolvidos, vejamos:

No que tange aos Aspectos Patrimoniais temos que, em regra, salvo formalização em sentido contrário assinada pelos companheiros, na união estável, se aplica o Regime da Comunhão Parcial de Bens, em que todos os bens adquiridos durante a relação passam a pertencem a ambos os envolvidos, independente de quem os adquiriu (não importa no nome de quem esteja e não é preciso comprovar colaboração financeira para a aquisição) e, no caso de separação serão objeto de partilha igualitária.

Lembrando aqui que, assim como no casamento, os bens advindos de herança ou doação, tanto antes da união quanto na constância da união, NÃO se comunicam entre o casal.

Caso haja interesse comum dos envolvidos, saiba que é possível alterar o regime de bens, o que pode ser feito diretamente em Cartório via Escritura Pública, mas, tal mudança só passa a vigorar a partir da data da escritura (ou seja, não tem quaisquer efeitos no tempo que já passou, onde ainda irá prevalecer a regra geral do regime de comunhão parcial de bens).

Ademais, no que diz respeito à Herança, no regime adotado na União Estável (em regra, o da comunhão parcial), o companheiro só terá direito aos bens adquiridos antes do início da união.

NÃO CONFUNDA! Em relação aos bens adquiridos durante à união o companheiro será meeiro (terá direito a metade). Em relação aos bens adquiridos antes da união será herdeiro, concorrendo com os descendentes e, caso haja, com os ascendentes.

Noutra sorte, em relação aos Aspectos Extrapatrimoniais temos que, de acordo com a lei civil brasileira, os parentes, cônjuges e companheiros podem exigir Alimentos uns dos outros. Isso significa que o ex-marido ou a ex-mulher poderão pedir pensão alimentícia um ao outro, no caso de separação e/ou divórcio.

Obs. os alimentos só serão concedidos em caso de comprovada necessidade (a título exemplificativo, para a garantia de subsistência do ex-companheiro até que este possa se reinserir no mercado de trabalho).

Por fim, ainda é pertinente se mencionar que é juridicamente possível que um companheiro na união estável adote o sobrenome do outro e/ou vice-versa com base na aplicação analógica da legislação aplicável ao casamento, o que pode ser feito diretamente no Cartório competente.

Nesta toada, é importante mencionar que tanto os aspectos patrimoniais quanto os extrapatrimoniais da união estável devem ser considerados e discutidos pelos companheiros, a fim de garantir uma convivência saudável e segura, além de evitar conflitos futuros em caso de separação ou falecimento.
