Muitos pais se perguntam se é possível descontar da pensão alimentícia valores gastos com outras despesas do filho, como presentes, viagens ou despesas extras. No entanto, a legislação brasileira é clara quanto à impossibilidade, em regra, de se compensar a pensão alimentícia.

De acordo com o artigo 1.707 do Código Civil, a pensão alimentícia não pode ser objeto de compensação, ou seja, não é possível abater da pensão alimentícia os gastos feitos diretamente com o filho. As coisas fornecidas extras, como presentes ou viagens, são consideradas como mera liberalidade e não como uma obrigação alimentar e não têm o condão de descontar do valor originário da pensão alimentícia.

Por exemplo, se o pai pagar uma viagem de férias para o filho, isso não pode ser descontado da pensão alimentícia. Isso porque a pensão alimentícia é um direito do filho e não pode, em regra, ser substituída por outros benefícios ou presentes.

No entanto, existe uma possibilidade excepcionalíssima de compensação de pensão alimentícia. Segundo entendimento do Superior Tribunal de Justiça (STJ), apenas em casos excepcionais é possível a compensação da pensão alimentícia, quando o pagamento extra se der comprovadamente ao atendimento de necessidade essencial do alimentado como saúde, habitação e educação.

A título ilustrativo, cita-se que, em 2017, o Tribunal entendeu que é possível a compensação da pensão alimentícia com despesas médicas, hospitalares e com educação, desde que essas despesas sejam comprovadamente indispensáveis para a subsistência e dignidade do alimentado.

Em outra decisão, julgado em 2019, se definiu que a pensão alimentícia não pode ser compensada com gastos realizados pelo alimentante que não sejam essenciais à subsistência do alimentado, como gastos com escola de inglês, música, dança, dentre outros.

Desta forma, é importante lembrar tudo depende da análise de cada caso concreto, não sendo recomendado que o alimentante faça descontos na pensão alimentícia sem a autorização do juízo competente, já que as decisões que acabam deferindo a compensação/desconto dos valores de pensão são excepcionais.

De maneira geral, pode-se afirmar que a pensão alimentícia deve ser paga integralmente, sem compensações por outras despesas e àquelas pagas de forma diversa da que fora originariamente determinado em decisão, pode ser, inclusive, objeto de questionamento e de cobrança judicial.

Por isso, é importante que os pais compreendam a importância da pensão alimentícia e a sua natureza alimentar. A pensão alimentícia tem como objetivo garantir as necessidades básicas do filho, como alimentação, moradia, saúde e educação, e deve ser paga mensalmente até que o filho atinja a maioridade ou se torne financeiramente independente – já abordamos melhor o assunto neste outro artigo.

Por fim, é importante ressaltar que a pensão alimentícia não é uma escolha, mas sim uma obrigação legal dos pais em relação aos seus filhos.
